Explanation
The City of Columbus ("City") is sole owner of certain real property leased for the Columbus Zoo, located in the vicinity of Riverside Drive ("S.R.257"), and Glick Road in Delaware, Ohio. Columbia Gas of Ohio, Inc. is engaged in a project which necessitates an easement through the Zoo property in order to relocate gas lines which were displaced by the Ohio Department of Transportation's ("ODOT") construction on S.R.257. The relocated gas pipelines will service the Zoo property. After investigation, the Recreation and Parks Department has determined that the gas service provided by the relocated pipeline benefit the City and should be granted at no charge. The following legislation authorizes the Executive Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc. gas line easements through those subject properties owned by the City, more fully described in the body of this legislation. The Columbus Zoo has reviewed the proposed easements and has no objection to the location.

Emergency Justification: Emergency action is requested as not to delay the benefit to the City, which will result from the proposed gas services provided to the Columbus Zoo.

To authorize the Director of the Recreation and Parks Department to execute those documents necessary to grant Columbia Gas of Ohio, Inc., gas line utility easements through certain Zoo property solely owned by the City, and in order to relocate gas pipeline lines which were displaced by the Ohio Department of Transportation's construction on Riverside Drive (S.R. 257) and to declare an emergency.

WHEREAS, the City of Columbus ("City") is sole owner of certain real property leased for the Columbus Zoo, located in the vicinity of Riverside Drive ("S.R.257"), and Glick Road in Delaware, Ohio; and
WHEREAS, Columbia Gas of Ohio, Inc. is engaged in a project which necessitates an easement through the Zoo property in order to relocate gas lines which were displaced by the Ohio Department of Transportation's ("ODOT") construction on S.R.257; and
WHEREAS, after investigation, the Recreation and Parks Department has determined that the relocated gas pipelines will service the Zoo property and should be granted at no charge; and
WHEREAS, an emergency exists in the usual daily operation of the City in that it is immediately necessary to authorize the Department of Recreation and Parks to immediately execute those instruments, prepared and approved by the Real Estate Division, Department of Law, necessary to execute those documents necessary to grant Columbia Gas of Ohio, Inc. a gas line easement in order to continue service to the Columbus Zoo, so as not to delay the resulting benefit to the City, thereby preserving the public health, peace, property, safety, and welfare; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of the Recreation and Parks Department be and hereby is authorized to execute those documents, as approved by the Department of Law, Real Estate Division, necessary to grant a gas utility line easement in, over, under, across and through the following described real property:
GAS PIPELINES EASEMENT TO
COLUMBIA GAS OF OHIO, INC.
LIBERTY TOWNSHIP, DELAWARE COUNTY, OHIO
Situated in the State of Ohio, County of Delaware, Township of Liberty, and being located in that 68.3 acre tract of land as described in a deed to the City of Columbus, Ohio (The Columbus Zoo) of record in Deed Volume 159, Page 103, all records referenced herein being to those located in the Recorder's Office, Delaware County, Ohio, and being a gas pipelines easement more particularly described as follows:
Beginning FOR REFERENCE at a point in the centerline of survey and construction of Riverside Drive (State Route 257) at a point of curve to spiral at Station 655+27.36, as indicated on the Ohio Department of Transportation road improvement plan "DEL-257-0.78", circa 2011, thence North 67°42'55" West, a distance of 68.69 feet to a point in the westerly right-of-way line of said Riverside Drive, thence along said right-of-way line with a non-tangent curve to the left having a radius of 728.94 feet, an arc length of 85.15 feet, a central angle of 6°41'34", and a chord bearing North 18°56'18" East a chord distance of 85.10 feet to a point being the TRUE PLACE OF BEGINNING of the herein described gas pipelines easement;
Thence North 75°48'20" West, through said 68.3 acre tract, a distance of 24.97 feet to a point in the easterly line of that existing gas easement to Columbia Gas of Ohio, Inc., of record in Official Record 0665, Page 664;
Thence North 23°14'08" East, continuing through said 68.3 tract, along said easement line, a distance of 20.25 feet to a point;
Thence South 75°48'20" East, continuing through said 68.3 acre tract, a distance of 22.00 feet to a point in the westerly right-of-way line of said Riverside Drive;
Thence along said right-of-way line with a non-tangent curve to the right having a radius of 728.94 feet, an arc length of 20.00 feet, a central angle of 1°34'20", and a chord bearing South 14°48'21" West a chord distance of 20.00 feet to the TRUE PLACE OF BEGINNING of the herein described gas pipelines easement, containing 0.011 acre (471 square feet) of land.
The above described gas pipelines easement is also shown on Exhibit "B" attached hereto and made a part hereof.
Bearings herein are referenced to said Ohio Department of Transportation plan "DEL-257-0.78".
This description was prepared by Westerville Land Surveying, LLC, based on record information, in August, 2011.
Section 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
