Explanation
BACKGROUND: This legislation authorizes the transfer of funds within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund and authorizes the Director of Public Utilities to modify Contract Number EL004230 with Vaughn Industries, LLC for street lighting improvements in the area known as Glenbrook. This legislation also amends the 2004 Capital Improvements Budget to reflect the transfer.
Amount of additional funds to be expended under modification: $12,804.60
(Original Contract Amount: $233,296.68)
Reason additional goods/services could not be foreseen initially: Field conditions required additional work to be completed so that National Electric Safety Code requirements could be met.
Reason other procurement processes are not used: Vaughn Industries, LLC was awarded the original contract based upon the lowest responsive and responsible bid received on March 10, 2004. It would not be feasible or economical to bid the additional work separately.
How cost of modification was determined: The contractor has submitted a detailed list of quantity overruns at prices as bid in the original contract. The Transportation Division, Inspection Services, concurs with the contractor's request.

Emergency action is requested in order that the project can be finalized and the contractor may be paid final payment in a timely manner.
FISCAL IMPACT: There are sufficient funds in the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund for this modification. It is necessary to transfer within the fund into the appropriate project.

To amend the 2004 Capital Improvements Budget; to authorize the transfer of $12,804.60 within the Voted Street Lighting and Electricity Distribution Improvements Fund; to authorize the Director of Public Utilities to modify an existing contract with Vaughn Industries, LLC for street lighting improvements in the area known as Glenbrook; to authorize the expenditure of $12,804.60 from the Voted Street Lighting and Electricity Distribution Improvements Fund; and to declare an emergency. WHEREAS, Contract EL004230 with Vaughn Industries LLC for the installation of street lighting improvements in the area known as Glenbrook was authorized by Ordinance No. 0612-2004, passed April 19, 2004; and
WHEREAS, it is necessary to modify Contract EL004230 to adjust for final quantity overruns for additional work necessary to meet National Electric Safety Code requirements; and
WHEREAS, the Transportation Division, Inspection Services, concurs with the contractor's request for said contract modification; and
WHEREAS, it is necessary to transfer funds and budget authority within the Voted 1995 and 1999 Street Lighting and Electricity distribution Improvements Fund to provide funding in the appropriate project for said modification; and
WHEREAS, it is necessary to amend the 2004 Capital Improvements Budget to reflect the transfer of funds; and
WHEREAS, emergency action is necessary to avoid further delay in the finalization of the contract and payment to contractor; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Electricity, in that it is immediately necessary to modify an existing contract for street lighting improvements in the area know as Glenbrook for the immediate preservation of the public health, peace, property safety and welfare, now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the 2004 Capital Improvements Budget is hereby amended as follows:

SECTION 2. That the City Auditor is hereby authorized and directed to transfer $12,804.60 within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvement Fund 553 from Street Lighting Project 670003, OCA 675017, Object Level Three 6625 to Glenbrook Subdivision Project Number 670610, OCA 670610, Object Level Three 6625.
SECTION 3. That the Director of Public Utilities is hereby authorized to modify contract EL004230 with Vaughn Industries, LLC by increasing the contract price by an amount of $12,804.60 to adjust for overruns necessitated by changes in the scope of work to meet National Electric Safety Code requirements.
SECTION 4. That for the purpose of said contract modification, the expenditure of $12,804.60, or so much thereof as may be needed, is hereby authorized from the Voted 1995 and 1999 Electricity Distribution and Street Lighting Improvements Fund 553, Glenbrook Street Lighting Project 670610, OCA 670610, Object Level Three 6625.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
