Explanation
The City of Columbus and the City of Bexley jointly desire to pursue improvements to the intersection of Main Street and Alum Creek Drive. The City of Bexley received a $400,000.00 Transportation Enhancement Program (TEP) project grant to improve the intersection of Main Street and Alum Creek Drive. The portion of the project that the City of Columbus' funding would improve involves the installation of sidewalk, curbs and handicap ramps. The Ohio Department of Transportation (ODOT) is administering this project and the City of Bexley has fronted the money to ODOT on behalf of the City of Columbus for construction work for the portion of the project that is within Columbus city limits. This legislation grants consent and proposes cooperation with Bexley for the improvement, appropriates funds and authorizes the expenditure of up to $30,600.00 to reimburse Bexley for construction expenses germane to Columbus.
Fiscal Impact: The City of Columbus' portion of the construction work for this intersection improvement is estimated at $30,600.00. This expense is not budgeted per se, however, the needed funds have been identified within the General Permanent Improvement Fund, General Roadway Street Improvement project. This ordinance appropriates the needed funds and authorizes their expenditure.
Emergency action is requested to allow for timely payment to the City of Bexley to maintain and enhance local intergovernmental relations.

To authorize the appropriation of $30,600.00 within the General Permanent Improvement Fund; to grant consent and propose cooperation with the City of Bexley for the improvement of the Main Street and Alum Creek Drive intersection; to authorize the Public Service Director to execute agreements with the City of Bexley as appropriate; to authorize the expenditure of $30,600.00 or so much thereof as may be needed to reimburse the City of Bexley for project construction expenses germane to the City of Columbus for the Transportation Division and to declare an emergency. WHEREAS, the City has identified the need for and proposes the improvement of a portion of public highway which is described as the reconstruction of the intersection of Main Street and Alum Creek Drive, with portions of said highways within the Columbus municipal corporation limits being hereinafter referred to as the improvement; and
WHEREAS, the City further desires cooperation from the Ohio Department of Transportation and the City of Bexley in the construction of said improvement; and
WHEREAS, the appropriation of $30,600.00 within the General Permanent Improvement Fund will provide project construction expenses germane to the City of Columbus; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary that funds be appropriated, consent be granted, cooperation proposed, agreements be authorized and monies authorized for expenditure to allow payment to the City of Bexley to occur as soon as possible to maintain and enhance local intergovernmental relations, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the sum of $30,600.00 be and hereby is appropriated from the unappropriated balance of the General Permanent Improvement Fund, Fund 748, and from all monies estimated to come into said Fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2006, to the Transportation Division, Department No. 59-09, Object Level One Code 06, Object Level Three Code 6631, OCA Code 748599 and Project 537650.
SECTION 2. That the monies appropriated in the forgoing Section shall be paid upon order of the Development Director and that no order shall be drawn or money paid except by voucher, the form of which shall be approved by the City Auditor.
SECTION 3. That the City of Columbus hereby grants consent and proposes cooperation with the Ohio Department of Transportation and the City of Bexley in the cost of the above-described improvement as follows:
The City of Columbus will reimburse the City of Bexley construction work performed within the project that is to be sold (bids solicited and contracts awarded) by the Ohio Department of Transportation. The City of Bexley has already expended $82,000.00 to date for the construction of this project; this includes Columbus' $30,600.00 share.
The City of Bexley is the lead agent for design and the Ohio Department of Transportation is the lead agent for the construction of this project.
SECTION 4. That the Public Service Director be and hereby is authorized on behalf of the City of Columbus to enter in agreements with the City of Bexley necessary to complete the construction of this improvement.
SECTION 5. That the for purposes of paying the City of Columbus' share of the cost of the construction work for this project, the sum of $30,600.00 or so much thereof as may be needed be and hereby is authorized to be expended from the General Permanent Improvement Fund, Fund 748, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 748599 and Project 537650.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made to be a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approved nor vetoes the same.
