Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into an agreement with R. D. Zande & Associates, Inc. for purposes of providing professional engineering services that are needed for the Southerly Wastewater Treatment Plant Support Facilities Project, for the Division of Sewerage and Drainage. This legislation also authorizes transferring funds from the Sewerage System Reserve Fund to the Ohio Water Pollution Control Loan Fund; and to amend the 2005 Capital Improvements Budget.
 
The purpose of this project is to provide support facilities needed for maintenance personnel at the Southerly Wastewater Treatment Plant, and will also provide support facilities for inspection and construction management personnel at both the Southerly and Jackson Pike Wastewater Treatment Plants.
 
2.  PROCUREMENT INFORMATION:
The basis for selection of the chosen professional engineering services firm: The Department of Public Utilities advertised a Request for Statement of Qualifications (RFSQ's) for the subject project professional engineering services, in accordance with the provisions of Section 329.13 of Columbus City Codes.  Six  firms submitted qualifications to the Director of Public Utilities on January 12, 2004 6, 2005 (SEE ATTACHED LEG. INFO).  An Evaluation Committee ranked all of the offerrors based upon the criteria specified within the advertised RFSQ.  The three, highest ranking firms submitted techinical proposals on July 12, 2004.
 
These proposals were reviewed and ranked by a Professional Engineering Services Selection Committee in order to determine the consultant best qualified to provide the services for this project.  The committee ranked the proposals on quality, feasibility and cost.   R. D. Zande & Associates, Inc., was selected to provide the engineering services for this project.
 
3.  FISCAL IMPACT:
There will be sufficient authority in the 2005 Capital Improvements Budget for these expenditures upon passage of this ordinance. The work of this contract is divided into three sequential steps; Preliminary Design, Detailed Design and Services During Construction. This contract is proposed to be entered into for an amount of $511,664.00, estimated to be sufficient to complete the Preliminary Design work.  Subsequent work steps will be funded incrementally by contract modification as they need to be undertaken. The estimated total cost for contract work is $3,135,664.00.
 
The Division is planning to obtain financial assistance for this project through a Water Pollution Control Loan Fund (WPCLF) loan from the Ohio Water Development Authority during the construction procurement phase of the project.
 
Title
To authorize the Director of Public Utilities to enter into an agreement with R. D. Zande & Associates, Inc. for professional engineering services in connection with the Southerly Wastewater Treatment Plant Support Facilities Project; to authorize the  transfer and expenditure of $511,664.00 from the Voted Sanitary Sewer Bond Fund; to amend the 2005 Capital Improvements Budget; for the Division of Sewerage and Drainage. Body
WHEREAS, the procurement was conducted in accordance with the Request For Statements of Qualifications (RFSQ) process set forth in Section 329.13, Columbus City Codes, 1959, and the Division's Evaluation Committee recommended three firms for further consideration, and R.D. Zande & Associates, Inc. was selected from among the three firms; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities, hereby requests this City Council to authorize the Director of Public Utilities to enter into an agreement for professional engineering services with R.D. Zande & Associates, Inc. in connection with the Southerly Wastewater Treatment Plant Support Facilities Project, and authorize the transfer, and expenditure of funds, and budget amendment as necessary for initiation of the contract; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized and directed to transfer $511,664.00 from within the Voted Sanitary Bond Fund No. 664 as follows:

Section 2.  That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
 
Section 3.  That the City Auditor is authorized to make any accounting changes to revise the funding source for any contract or contract modifications associated with the expenditure of the funds transferred under Section 1., above should the city successfully receive other funding for this project.
 
Section 4.  That the Director of Public Utilities be, and hereby is, authorized to enter into a professional engineering services contract with R.D. Zande & Associates, Inc., 1500 Lake Shore Drive, Suite 100, Columbus, Ohio 43204, in connection with the capital improvements projects identified within Section 3 herein, in accordance with the terms and conditions of the Contract on file in the office of the Division of Sewerage and Drainage's Technical Engineering Section.
 
Section 5.  That the expenditure of $511,664.00, or as much thereof as may be needed, be and the same hereby is authorized from the Voted Sanitary Bond Fund No. 664; Division 60-05; Object Leve 3 No. 6678; within the following project:

Section 6.  That the 2005 Capital Improvements Budget Ordinance No. 1070-2005 is hereby amended as follows, in order to provide sufficient budget authority for the execution of a professional engineering service contract award as referenced in the preamble hereto:
