Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN26-003) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on May 26, 2026. Franklin County approved the annexation on June 23, 2026 and the City Clerk received notice on July 9, 2026.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

To accept the application (AN26-003) of the City of Columbus Department of Public Service (DPS) for the annexation of certain territory containing 0.39± acres in Blendon Township. ($0.00)

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Blendon Township was filed on behalf of City of Columbus DPS on May 26, 2026; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on June 23, 2026; and

WHEREAS, on July 9, 2026, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition; and NOW, THEREFORE,

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by City of Columbus DPS in a petition filed with the Franklin County Board of Commissioners on May 26, 2026 and subsequently approved by the Board on June 23, 2026 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, Franklin County, Blendon Township, Quarter Township 3, Township 2 North, Range 17 West, United States Military Lands, being all of a tract of land known as parcel 6-WDV and conveyed to the State of Ohio, as recorded in Instrument Number 202402280019922, all of a tract of land known as parcel l 4-WDV3 and conveyed to City of Columbus, Ohio, a Municipal Corporation, as recorded in Instrument Number 202212220172236, all of a tract of land known as parcel 14-WDV2 and conveyed to City of Columbus, Ohio a Municipal Corporation, as recorded in Instrument Number 2022122201 72234, all of a tract of land known as parcel 7-WDV and conveyed to City of Columbus, Ohio, a Municipal Corporation, as recorded in Instrument Number 202509040096892, all of a tract of land known as parcel 9-WDV and conveyed to City of Columbus, Ohio, a Municipal Corporation, as recorded in Instrument Number 202310310113587, part of a tract of land known as parcel 86-WD and conveyed to the State of Ohio, as recorded in Deed Book 3267, Page 295, part of a tract of land known as parcel 89-WD and conveyed to the State of Ohio, as recorded in Deed Book 3295, Page 138 and part of a tract of land known as parcel 46-WD and conveyed to Franklin County Commissioners, as recorded in Instrument Number 200001130009593.

BEGINNING at the southwest corner of a tract of land known as parcel 6-WDV and conveyed to the State of Ohio as recorded in Instrument Number 202402280019922, a southeast corner of a tract of land conveyed to Speedway LLC, a Delaware Limited Liability Company, as recorded in Instrument Number 201207100098146 and Instrument Number 201207100098147, the northeast corner of a tract of land known as parcel 43-WD and conveyed to Franklin County Commissioners, as recorded in Instrument Number 200103210057198 and the northwest corner of a tract of land known as parcel 14-WDVl and conveyed to City of Columbus, Ohio, a municipal corporation, as recorded in Instrument Number 202212220172234, being on the existing City of Columbus Corporation Line as established in Columbus Ordinance 2185-01 and the north existing right of way of Morse Road (C.R. 17), being Ohio State Plane Grid Coordinate Northing: 750267.328 and Easting 1845988.489;

Thence on the north existing right of way of said Morse Road, the west line of said parcel 6-WDV and a southeast line of said Speedway LLC tract, North 04 degrees 06 minutes 33 seconds East, a distance of 50.15 feet to the northwest corner of said parcel 6-WDV and an angle point in the southeast line of said Speedway LLC tract;

Thence continuing on said existing City of Columbus Corporation Line as established in Columbus Ordinance 2185-01, through said Franklin County Commissioners tract (Instrument Number 200001130009583) and through said State of Ohio tract (Deed Book 3295, Page 138 and Deed Book 3237, Page 295), North 86 degrees 12 minutes 23 seconds West, a distance of 134.62 feet to the east line of said City of Columbus tract (Instrument Number 202212220172234), and on the west line of said State of Ohio tract (Deed Book 3237, Page 295);

Thence continuing on said existing City of Columbus Corporation Line as established in Columbus Ordinance 2185-01, crossing through then on the north line of said City of Columbus tract (Instrument Number 202212220172234), the south line of said City of Columbus tract (Instrument Number 202212220172236) and the south line of said tract conveyed to the State of Ohio (Instrument Number 202402280019922), North 86 degrees 15 minutes 01 seconds West, a distance of 111.02 feet to the Point of Beginning, containing 0.390 acres.

The coordinates and bearings for this description are based on Grid North, of the Ohio State Plane Coordinate System, South Zone, NAD83(201 l).

This description was prepared and reviewed under the supervision of Travis D. McCarty, Professional Surveyor No. 8347 from an actual field survey for the City of Columbus, in November, 2019 as part of City of Columbus Project 3745-E, also known as FRA-3-22.90.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3. That pursuant to the provisions of Section 503.07 of the Ohio Revised Code the Director of the Department of Development be and is hereby authorized and directed on behalf of the City of Columbus to present to the Board of Commissioners of Franklin County, Ohio, a petition requesting such changes in and extensions of the boundary lines of Montgomery Township as may be necessary so that said township may include therein that portion of Blendon Township, which by the order of the Board of County Commissioners of Franklin County, Ohio, on June 23, 2026 was approved for annexation to the city of Columbus, so as to make the boundaries of Montgomery Township co-extensive with the corporate limits of the said city of Columbus in accordance with the maps attached to said petition.

SECTION 4. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
