Title: To authorize the Director of Public Service to execute a professional services contract modification with HNTB, Ohio, Inc. for construction related inspection services during the construction of the Traffic Management Center project; to amend the 2012 C.I.B; to authorize the transfer and expenditure of $245,000.00 within the Streets and Highways G.O. Bonds Fund; and to declare an emergency. ($245,000.00)
Explanation
1.  BACKGROUND
This legislation authorizes the Director of Public Service to execute a professional services contract modification to the  Traffic Signal Installation - Columbus Traffic Signal System Phase A contract with HNTB Ohio, Inc for construction related inspection services during the construction of the Traffic Management Center project in an amount up to $245,000.00.  
 
Work performed to as part of this contract includes:
Design of the fiber optic backbone to migrate the Columbus Traffic Signal System (CTSS) to an open architecture that can serve central Ohio stakeholders with system connectivity and interoperability.  This design included the 85 miles of the high speed fiber optic network that will support new hardware and software for a new modern signal system.  The first modification designed the renovation of 1881 25th facility for the location of the Traffic Management Center from 109 North Front St.
Current modification work:
This modification will provide construction related inspection services during the construction of the Traffic Management Center project including but not limited to requests for information (RFI)'s and similar, electronic scheduling using, shop drawings & submittal review, change order process, progress meetings with meeting minutes, pay request review and approval, punch list(s)/punch list(s) approval, as-built and close out documentation and drawings, as-built drawings and as-built disc, one-year walk through.
The first modification to this contract designed the renovation of 1881 25th facility for the location of the Traffic Management Center from 109 North Front St.  The modification was $400,000.00 passed by Ordinance 0613-2012, on April 25, 2012.  The Contract Number is EL012822.
This modification is necessary because the imminent demolition of 109 North Front St. was not anticipated when the original contract was written in 2007.
In Columbus, typically for facility related projects such as new  buildings or renovations, the firm performing architecture related services provides the inspection and construction management during construction.  HTNB and their team has the knowledge and experience to perform these services.

3.  FISCAL IMPACT
Funding for this contract is budgeted and available within the Streets and Highways G.O. Bonds Funds Fund.  
 
4.  EMERGENCY DESIGNATION
The Department of Public Service is requesting City Council to enact this legislation as an emergency measure, in order to allow for the work in this contract to proceed and the schedule for this project to be maintained.

WHEREAS, ordinance 1972-2007 authorized the Director of Public Service to enter into contract with HNTB, Ohio, Inc for the Traffic Signal Installation - Columbus Traffic Signal System Phase A contract; and
 
WHEREAS, work performed as part of this contract included design of the fiber optic backbone to migrate the Columbus Traffic Signal System (CTSS) to an open architecture that can serve central Ohio stakeholders with system connectivity and interoperability; and
WHEREAS, ordinance 0613-2012 authorized the first modification to designed the renovation of 1881 25th facility for the relocation of the Traffic Management Center from 109 North Front St; and
WHEREAS, this ordinance authorizes modification number two to provide construction related inspection services during the construction of the Traffic Management Center project including but not limited to requests for information (RFI)'s and similar, electronic scheduling using, shop drawings & submittal review, change order process, progress meetings with meeting minutes, pay request review and approval, punch list(s)/punch list(s) approval, as-built and close out documentation and drawings, as-built drawings and as-built disc, one-year walk through; and
 
WHEREAS, it is necessary to amend the 2012 C.I.B. to establish authority in the appropriate project detail number for this project; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Division of Design and Construction, in that the contract should be modified and increased  immediately so that the work to be performed as part of this modification can proceed according to the schedule for the relocation of the Traffic Management Center, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL007678, with HNTB Ohio, Inc., 330 West Spring Street, Suite 310, Columbus, OH 43215, by up to $245,000.00 for additional work in accordance with the terms as shown on the modification on file in the Office of Support Services.
SECTION 2.  That the 2012 Capital Improvement Budget be amended as follows to provide sufficient authority for this modification:

SECTION 6.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
