Explanation

 

1.  BACKGROUND:

This ordinance authorizes the Director of Technology to modify a professional services and software licensing contract with RSM US LLP, to develop a comprehensive cyber security program strategy for the Department of Columbus Water & Power.

 

The IT and Cybersecurity Products and Services contract with RSM US, LLP provides the City with cybersecurity capabilities necessary to identify, prioritize and mitigate a wide range of risks related to the City’s use of IT. The contract is used to assess current practices against best practice, to identify and prioritize gaps that introduce cyber-risks, and to develop and execute strategies, road maps and corrective action plans for managing risks.

 

Ordinance 0260-2023 authorized the Director of Technology to enter a contract with RSM US LLP for Cybersecurity Products and Services.  The contract was advertised through Vendor Services as RFQ022363 for the purchase of the above-described services and support, and was awarded to RSM US LLP. The term of the initial contract was for three years starting March 22, 2023, in the amount $2,500,000.00.

 

This ordinance authorizes the Director of the Department of Technology to modify the original contract in order to add funds to pay for the additional professional services and software licensing, as well as provide flexibility to address additional unforeseen issues that may arise for the Department of Columbus Water & Power in the amount of $120,000.00. 

 

1.1  Amount of additional funds to be expended:

The contract amount including all modifications:  $2,620,000.00 

 

1.2  Reasons additional goods/services could not be foreseen: 

This is an unforeseen modification that is necessary to provide additional funding to ensure continuity of service and maintain operational efficiency for the Department of Columbus Water & Power, to develop a comprehensive cyber security program strategy that addresses the unique needs of both Operational IT systems (SCADA) and general IT infrastructure with a forward-thinking cybersecurity program strategy that safeguards Operational Technology systems (OT/SCADA), ensuring resilience, reliability, and protection against evolving cyber threats.  This was not included as part of the original scope of the project.

 

1.3  Reason other procurement processes are not used:

The City currently works with RSM US LLP for cyber security services.  This modification adds funds to include the Department of Columbus Water & Power.  It is in the best interest of the City to modify this contract.

 

1.4  How cost of modification was determined:

The cost of this contract modification is based on the pricing as defined in the original proposal.

Contract compliance will need to be renewed before the contract can be executed.

 

3.  FISCAL IMPACT:

Funding in the amount of $120,000 is budgeted and available in the Department of Technology’s, Information Services Division’s Operating Fund, Fund 5100.

 

4. EMERGENCY DESIGNATION

Emergency designation is being requested for these services that are necessary to support daily operation activities, to ensure services start as soon as possible, and to establish a purchase order at the earliest possible date.

Body

 

WHEREAS, Ord. No. 0260-2023, authorized the Director of Technology to enter a contract with RSM US LLP for Cybersecurity Products and Services; and

 

WHEREAS, this ordinance modifies the contract to add $120,000.00 to add additional funding to support professional services and software licensing to include the Department of Columbus Water & Power; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Technology in that it is immediately necessary to authorize the Director to modify the contract with RSM US LLP for Cybersecurity Products and Services for the Department of Columbus Water & Power, thereby preserving the public health, safety, property, and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Technology be, and hereby is, authorized to modify the contract with RSM US LLP for Cybersecurity Products and Services contract in an amount up to $120,000.00.

 

SECTION 2.  That the expenditure of $120,000.00, or so much thereof as may be necessary, is hereby authorized to be expended from the Department of Technology, Information Services Operating Fund, as follows in the attachment to this ordinance: (Please see attachment 1997-2025 EXP).

 

SECTION 3. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.

 

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
