Explanation
This ordinance requests authority for the Director of Public Utilities to increase the agreement to pay Delaware County for provision of sewer services during 2003, based on an agreement entered into in 1991 authorized by Ordinance No. 2424-91. This agreement authorizes discharge of sewage from Delaware County into the sewers of the City of Columbus and from the City of Columbus system into the Delaware County sewer system in order to avoid duplication of wastewater treatment facilities.
This ordinance is requested to be an emergency measure to allow payment of an invoice received and currently in process within the division. Higher than anticipated flows have resulted in invoice amounts over estimates.
FISCAL IMPACT: Funds are budgeted yearly within the division's operating budget for the estimated amount of these payments. Adequate funding remains to cover these expenses. Funding was originally estimates at $1,200,000. This ordinance increases the agreement by $400,000. This funding level should allow payment through January of 2004.

WHEREAS, Ordinance No. 2424-91 authorized an agreement between the City of Columbus and Delaware County based on a determination that it is in the best economic interests of both parties to avoid duplication of sanitary wastewater treatment facilities, and
WHEREAS, this agreement provides for payment by each party for services provided by the other party within certain service area boundaries, and
WHEREAS, funds are budgeted yearly by the Division of Sewerage and Drainage for these payments, and
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public utilities, in that it is immediately necessary to authorize payment to Delaware County for provision of Sewer services for the preservation of the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Director of Public Utilities is herby authorized to make payment to Delaware County, based on an agreement authorized by Ordinance No. 2424-91, for provision of sewer services.
Section 2. That the expenditure of $400,000.00 is herby authorized for the Sewer System Operating Fund No. 650, OCA 605006, OL1 03, OL3 3390 to pay the cost thereof.
Section 3. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
