Explanation
 
Background:  This legislation authorizes a modification to the design contract with Burgess & Niple for the Kinnear Road Improvement project.  This project is being designed to investigate engineering alternatives for the widening, drainage, and streetscape features of Kinnear Road.  The limits of the project are North Star Road to the west and Kenny Road to the east.
 
The contract modification is necessary to accelerate the delivery of the source document from 12 months to 8 months allowing the Transportation Division the opportunity to position the City to apply for additional Federal and State Capital dollars.
 
This modification is an addition to the original scope of services but is a continuation of the existing work being performed and it would not be practical to contract with a different consultant.  
 
Current hourly rate, the overhead rate and the percentage of profit that were negotiated at the beginning of this project were used to determine the amount of this modification.  Burgess & Niple, Inc., CC #31-0885550, expiration 1/8/09, was selected in July, 2006 in accordance with Chapter 329 for professional service contracts.  No new hourly rates have been negotiated for this modification.  The overhead rate and percentage of profit from the original contract were used because they are still valid.
 
The original contract amount was $500,000.00.  There have been no prior modifications.  The total amount of Modification No. 1 is $22,782.00.  The contract amount, including all modifications is $522,782.00.
 
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule for construction and preserve the safety and welfare of the public.
 
Fiscal Impact:  Funds for this project in the amount of  $22,782.00 are available in the 1995, 1999, 2004 Voted Street and Highway Funds for the Transportation Division.

Body
 
WHEREAS, contract no. EL 006395 was authorized by ordinance no.1329-2006E, passed July 24, 2006, executed and approved by the City Attorney on September 12, 2006; and
 
WHEREAS, it is necessary to modify this contract to increase the Scope of Services as per the consultant's letter dated January 8, 2007 for the Kinnear Road Improvement project; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that the contract should be modified and increased  immediately so that the work may proceed without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of Public Service be and is hereby authorized to modify and increase contract no. EL 006395, with Burgess & Niple, Inc., to complete the design, construction plans, and permits for the Kinnear Road Improvements project in accordance with the plans on file in the office of the Public Service Director.
 
Section 2.  That for the purpose of paying the cost thereof, the sum of $22,782.00 or so much thereof as may be needed, is hereby authorized to be expended from the 1995, 1999, 2004 Voted Street and Highway Fund for the Transportation Division, Dept/Div. 59-09, OCA code 644385, Object Level 01/03 Codes 06/6682, and project number 530161 (Roadway Improvements).
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
