Explanation
 
Background: It is the Transportation Division's responsibility to maintain street curbs through out the City of Columbus.  The On Call Curb Restoration - 2005 project involves the replacement of deteriorated and hazardous curb throughout the City of Columbus.  Curb restoration will enhance neighborhood appearances, provide better storm water drainage, and help maintain a structurally sound roadway.  
 
Bids were solicited and received by the Transportation Division on March 17, 2005 as follows:

The bid proposal stated that the bid quantities were estimated and that the bid quantities may be increased or decreased, depending on the funds available.  Due to the better-than-expected unit prices in the submitted bids, an increased amount of curb restoration work can be completed without exceeding budget.  Contract quantities were increased without changing the ranking of the bids received. The Transportation Division recommends a bid award to the lowest, best, most responsive, and most responsible bid submitted by Columbus Asphalt Paving, Inc.  Based upon the revised quantities and the bid unit costs the new contract amount would be:

Columbus Asphalt Paving, Incorporated, has agreed to the revised quantities at the contract bid unit costs.   The Transportation Division will perform the inspection work appropriate to this contract and will absorb its expense.
 
Fiscal Impact:  The Transportation Division budgeted $550,000.00 in the 2004 Capital Improvements Budget (CIB) for curb replacement.  All funds from the July 2004 bond sale for curb replacement/restoration have been expended or encumbered.  This ordinance authorizes an expenditure of $750,000.00.  Approximately $1 million has been expended on similar contracts for curb restoration over the past three years.
 
This ordinance amends the 2004 Capital Improvements Budget to allow for this expenditure.  The curb replacement project is being increased by $1,050,000.00 from $550,000.00 to $1,600,000.00 with a corresponding decrease in the Morse Road Area Investment project.  This amendment accurately reflects past and planned expenditures from these projects.
 
Emergency action is requested to ensure this contract is executed and in place prior to the commencement of the construction season.

Body
 
WHEREAS, the need exists for replacement of deteriorated and damaged curbs throughout the City of Columbus; and
 
WHEREAS, bids were received and tabulated on March 17, 2005 for On Call Curb Restoration - 2005 project; and
WHEREAS, a satisfactory low bid has been received; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the Public Service Director to enter into a contract with Columbus Asphalt Paving, Inc.to ensure the contract's execution prior to the commencement of the Central Ohio construction season; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the 2004 Capital Improvements Budget be and hereby is amended as follows:

SECTION 3.  That the Public Service Director be and is hereby authorized to enter into a contract for On Call Curb Restoration - 2005 project in the amount of $750,000.00 with Columbus Asphalt Paving, Incorporated, 1196 Technology Drive, Columbus, Ohio 43230 as the lowest, best, most responsive, and most responsible bidder therefore and in accordance with the specifications and plans on file in the office of the City Engineer, which are hereby approved.
 
SECTION 4.  That for the purpose of paying the cost of the contract, the sum of $750,000.00, or so much thereof as may be necessary, is hereby authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6631, OCA Code 644385 and Project 530210.
 
SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
