Explanation
 
Background:    The City of Columbus, Recreation and Parks Department desires to purchase certain real property located in the vicinity of Starr Avenue and St. Clair Avenue.  FCI National Fund II LLC, owner, desires to sell the property to the City.  This purchase is in connection with the proposed Milo Grogan Recreation Center Expansion Project.  After investigation, the Department of Recreation and Parks has determined that the purchase of the property would be in the best interest of the City of Columbus and should be allowed.  The following legislation authorizes appropriation and transfer of $25,000.00 within the Recreation and Parks Permanent Improvement Fund No. 747, to amend the 2006 capital improvements budget,  the Director of the Recreation and Parks Department to execute those documents necessary to enter into a contract by and between the City of Columbus, Ohio and FCI National Fund II LLC for the purchase of the property, and to expend $25,000.00 for cost relevant to its acquisition.
 
 
Fiscal Impact:    The Recreation and Parks Department has determined that the funding necessary for this purchase will come from the Recreation and Parks Permanent Improvement Fund to meet the financial obligation of this project
 
 
Emergency Justification:    An emergency exists in the usual daily operation of the Recreation and Parks Department in that it is immediately necessary to appropriate and transfer $25,000.00 within the Recreation and Parks Permanent Improvement Fund to allow this acquisition to proceed in agreement with the closing transaction deadline and other terms and conditions of the purchase contract.

Body
 
WHEREAS,      the city of Columbus, recreation and parks department desires to purchase certain real property located in the vicinity of Starr Avenue and St. Clair Avenue consisting of approximately 0.09 +/- acres; and
 
WHEREAS,      FCI National Fund II LLC, owner, desires to sell the property to the city; and
 
WHEREAS,      the purchase of the property is in connection with the proposed Milo Grogan recreation center expansion project; and
 
WHEREAS,      after investigation, the department of recreation and parks has determined that the purchase of the property would be in the best interest of the city of Columbus and should be allowed, and
 
WHEREAS,      it is necessary to expend $25,000.00 from the recreation and parks permanent improvement fund for the purchase of the subject real property and expenses necessary to its acquisition; and
 
Whereas,      an emergency exists in the usual daily operation of the city of Columbus, in that it is immediately necessary to authorize the director of the recreation and parks to execute those documents necessary for the purchase of said real property for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
      Section 1.      That the Director of the Recreation and Parks Department be, and hereby is, authorized to execute those documents, as approved by The Department Of Law, Real Estate Division, necessary for the purchase of that 0.09 +/- acres real property commonly known as 831 North St. Clair Avenue, located in the city of Columbus, Franklin County, Ohio being tax Parcel Number 010-044904-00.
 
      Section 2.      That the city auditor is hereby authorized to appropriate $25,000.00 to the Recreation and Parks Permanent Improvement Fund No. 747, Dept. 51-01, Project No. 747999, OCA Code 900747, and Object Level 3 No. 5501.
 
      Section 3.      That the city auditor is hereby authorized to transfer $25,000.00 within the Recreation and Parks Permanent Improvement Fund No. 747, Dept. 51-01, Project No. 747999, OCA Code 900747, and Object Level 3 - 5501 to Park Improvements, Project No. 510017, OCA Code 640862, and Object Level 3 - 6601.
 
      Section 4.      That the expenditure of $25,000.00, or so much thereof as may be necessary for the Recreation and Parks Land Acquisition Project, Project 510017, Div/Dept. 51-01, from the Recreation and Parks Permanent Improvement Fund, # 747 Fund, OCA Code 640862, Object Level Three 6601, for the purchase of said real property is hereby authorized.
 
           Section 5.         That the 2006 Capital Improvements Budget Ordiance No.1108-2006, is hereby amended as follows, in order to provide sufficient budget authority for the exectuion of this legislation as well as previously approved legislation.

      Section 6.      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor or ten days after passage if the mayor neither approves nor vetoes the same.
