Explanation
BACKGROUND: The Franklin County Municipal Court Judges entered into a contract with Asist Translation Services, Inc. effective February 1, 2005, for the fourth year of a four-year contract to provide language interpreter services to the Court under the authority of ordinance number 0185-2005 passed by City Council on February 7, 2005. On December 11, 2005 a sixty-day extension of the contract was passed by City Council (ordinance number 2131-2005) in order to permit the Court time to draft specifications for the re-bid of language interpreter services. Ordinance number 0501-2006 which passed March 13, 2006 authorized the Court to extend services under the original terms of the contract through November 30, 2006. Due to the complexity of the services being provided, the Court still finds it needs more time to complete the specification drafting and bid processes.
This legislation authorizes the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into contract with Asist Translation Services through May 31, 2007.

FISCAL IMPACT: Funds for this contract are budgeted and available within the Municipal Court Judges 2006 general fund appropriations. Thus far in 2006, the Court has expended $65,259.50 with Asist. During 2005, the Court expended $106,457.50 with Asist; during 2004, the Court expended $99,860.00.
EMERGENCY: This ordinance is submitted as an emergency to allow the financial transaction to be posted in the city's accounting system as soon as possible. Up-to-date financial posting promotes accurate accounting and financial management.

To authorize the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into contract with Asist Translation Services, Inc. for language interpreter services for the Franklin County Municipal Court Judges; to authorize the expenditure of an amount not to exceed $54,000; to waive the competitive bidding provisions of the Columbus City Code; and to declare an emergency. WHEREAS, it is necessary that the Franklin County Municipal Court provide foreign language interpreter services for non-English speaking persons that may come before the Court; and
WHEREAS, it is necessary to enter into original contract with Asist Translation Services, Inc., the Court's current vendor to provide translation services through May 31, 2007 so that the Court may complete the specification writing and bidding processes; and
WHEREAS, it is in the best interest of the city to waive the competitive bidding provisions of the Columbus City Code and procure the needed foreign language translation services from Asist, Inc.; and
WHEREAS, an emergency exists in the usual daily operation of the city, in that it is immediately necessary to authorize the Administrative and Presiding Judge of the Franklin County Municipal Court to enter into contract and authorize the expenditure with Asist Translation Services, Inc. for provision of foreign language interpreter services, thereby preserving the public health, peace, property, safety and welfare, Now, Therefore;
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the Administrative and Presiding Judge of the Franklin County Municipal Court be and is hereby authorized to enter into a contract with Asist Translation Services, Inc. for foreign language interpreter services to the Franklin County Municipal Court Judges the period ending May 31, 2007.
Section 2. That the expenditure of $54,000, or as much thereof as may be necessary is hereby authorized from the Franklin County Municipal Court Judges, department number 2501, general fund, fund number 010, oca 250191 , object level 1 - 03, object level 3 - 3445.
Section 3. That in accordance with section 329.27 of the Columbus City Code, this Council finds the best interest of the city is served by waiving, and does hereby waive Section 329.06 (Competitive Sealed Bidding) of the Columbus City Code.
Section 4. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
