ECONOMIC DEVELOPMENT DIVISION
BACKGROUND: The need exists to amend Ordinance No. 0713-2025 (the “ORDINANCE”), approved by Columbus City Council (“Council”) on March 31, 2025. The ORDINANCE authorized the Director of the Department of Development to amend the Enterprise Zone Agreements (the, “AGREEMENTS”) for a the second time for Assignment & Assumption with The Hub XO, LLC (I, II, III, VI), to remove The Hub XO, LLC (I, II, III, VI), as the ENTERPRISES and parties to the AGREEMENTS, and to be replaced with EXETER 1260 LONDON GROVEPORT, LLC, EXETER 1302 LONDON GROVEPORT, LLC, EXETER 6322 COLLINGS, LLC, and EXETER 6201 COLLINGS (2024), LLC as the ENTERPRISES and parties to the AGREEMENTS, and to redefine the PROJECT SITE.
Prior to executing the Second Amendment to the AGREEMENTS, the 90-day period needed to execute the Second Amendment to the City of Columbus Enterprise Zone Agreements expired, and the ENTERPRISES are requesting the 90-day period be extended to execute the AGREEMENTS.
The need now exists to amend the ORDINANCE. The ENTERPRISES are requesting the ORDINANCE be amended to revise the 90-day period needed to execute the Second Amendment to the AGREEMENTS, to 90 days after passage from this ordinance. This will not impact the scope of the project as authorized by Columbus City Council. All job retention, job creation, and investment commitments remain unchanged.

WHEREAS, the need exists to amend Ordinance No. 0713-2025, which was approved by Columbus City Council on March 31, 2025; and
WHEREAS, the ordinance authorized the Director of the Department of Development to amend the Enterprise Zone Agreements (the, “AGREEMENTS”) for a the second time for Assignment & Assumption with The Hub XO, LLC (I, II, III, VI), to remove The Hub XO, LLC (I, II, III, VI) as the ENTERPRISES and parties to the AGREEMENTS, and to be replaced with EXETER 1260 LONDON GROVEPORT, LLC, EXETER 1302 LONDON GROVEPORT, LLC, EXETER 6322 COLLINGS, LLC, and EXETER 6201 COLLINGS (2024), LLC as the ENTERPRISES and parties to the AGREEMENTS, and to redefine the PROJECT SITE; and
WHEREAS, prior to executing the Second Amendment to the AGREEMENTS, the 90-day period needed to execute the Second Amendment to the City of Columbus Enterprise Zone Agreements had expired and the ENTERPRISES are requesting the 90-day period be extended to execute the AGREEMENTS; and
WHEREAS, the need exists to now seek an amendment from Columbus City Council for Ordinance No. 0713-2025, to revise the 90-day period needed to execute the Second Amendment to the City of Columbus Enterprise Zone Agreement, to 90 days after passage from this ordinance; NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Section 5 of Ordinance No. 0713-2025 is hereby amended to revise the 90-day window needed to execute the Second Amendment to the City of Columbus Enterprise Zone Agreements, to 90 days after the passage of this ordinance, as follows, with additions in underline and deletions is strikethrough:
SECTION 5. That this SECOND AMENDMENT for Assignment & Assumption to the City of Columbus Enterprise Zone Agreement be executed by EXETER 1260 LONDON GROVEPORT, LLC, EXETER 1302 LONDON GROVEPORT, LLC, EXETER 6322 COLLINGS, LLC, and EXETER 6201 COLLINGS (2024), LLC within ninety ninety (90 90) days of passage of this ordinance, or this ordinance and the incentive authorized herein shall be null and void the passage of Ordinance No. 2353-2025.
SECTION 2. That existing Section 5 of Ordinance No. 0713-205 is hereby repealed.
SECTION 3. That the remaining terms of the City of Columbus Enterprise Zone Agreements remain in full effect relative to the Ordinance.
SECTION 4. That the Second Amendment for Assignment & Assumption to the City of Columbus Enterprise Zone Agreements must be signed by EXETER 1260 LONDON GROVEPORT, LLC, EXETER 1302 LONDON GROVEPORT, LLC, EXETER 6322 COLLINGS, LLC, and EXETER 6201 COLLINGS (2024), LLC within 90 days of passage of this ordinance, or this ordinance and the credit herein shall be null and void.
SECTION 5. That this Ordinance shall take effect and be in force from and after the earliest period allowed by law.
