Explanation

 

BACKGROUND:

This ordinance approves the acceptance of certain territory (AN25-010) by the city of Columbus. The Ohio Revised Code stipulates that to be effective, City acceptance must take place a minimum of 60 days from the receipt by the City Clerk of the approval notice from the county. If City Council does not accept the ordinance within 120 days of its first consideration, the annexation will be considered rejected. This petition was filed with Franklin County on May 13, 2025. City Council approved a service ordinance addressing the site on May 19, 2025. Franklin County approved the annexation on June 24, 2025 and the City Clerk received notice on July 3, 2025.

FISCAL IMPACT:

Provision of municipal services does represent cost to the City; however, the annexation of land also has the potential to create revenue to the City.

 

Emergency designation: An emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to present this ordinance to the Franklin County Board of Commissioners in accordance with the Ohio Revised Code all for the preservation of the public peace, property, health, safety, and welfare.

 

 

Title

 

To accept the application (AN25-010) of Mifflin Township for the annexation of certain territory containing 14.0± acres in Mifflin Township and to declare an emergency. ($0.00)

 

Body

 

WHEREAS, a petition for the annexation of certain territory in Mifflin Township was filed on behalf of Mifflin Township et al. on May 13, 2025; and

WHEREAS, the petition was considered and approved by the Franklin County Board of Commissioners at a hearing on June 24, 2025; and

WHEREAS, on July 3, 2025, the City Clerk received from Franklin County a certified copy of the resolution addressing the petition; and

WHEREAS, sixty days have now elapsed since receipt of the resolution in accordance with the provisions of the Ohio Revised Code; and

WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory addressed by the petition;

 

WHEREAS,  an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance due to the need of the developer needing to proceed with the development of this site for multi-family units for the immediate preservation of the public peace, property, health and safety; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS

SECTION 1. That the annexation proposed by Mifflin Township et al. in a petition filed with the Franklin County Board of Commissioners on May 13, 2025 and subsequently approved by the Board on June 24, 2025 is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:

Situated in the State of Ohio, County of Franklin, Township of Mifflin, being part of Quarter Township 4, Township 1, Range 17, United States Military Lands and containing 14.0± acres of land, more or less, said 14.0± acre tract being all of the remainder piece of the Original 7.3695 acre tract of land conveyed to the Board of Trustees of Mifflin Township of record in Instrument Number 201609200126734, being all of a remainder piece of a tract of land conveyed to Mifflin Township of record in Instrument Number 201711300169273, being all of the remainder of Parcel I and Parcel II as described and conveyed to Central Ohio Community Improvement Corporation of record in Instrument Number 202005220071148 and all of another tract of land conveyed to Central Ohio Community Improvement Corporation of record in Instrument Number 202201040001695, said 14.0± acres more particularly described as follows:

Beginning for Reference at a Franklin County Monument found, "FCGS 5509 Reset", being in the westerly line of a 0.093 acre tract of land described as Parcel 3-WD and conveyed to the Franklin County Commissioners of record in Instrument Number 200504250076436 and being in the centerline of Stelzer Road (R/W-Varies);

Thence N 03° 28' 46" E, along the westerly line of said Parcel 3-WD and along said centerline, 34.3± feet to the northwesterly comer of said Parcel 3-WD and the southwesterly comer of a 0.186 acre tract of land described as Parcel 4-WD and conveyed to the Franklin County Commissioners of record in Instrument Number 200408120188058;

Thence S 86° 31' 14" E, along the northerly line of said Parcel 3-WD, along the southerly line of said Parcel 4-WD and across the right-of-way line of said Stelzer Road (R/W-Varies), 45.0± feet to a northeasterly comer of said Parcel 3-WD, the southeasterly comer of said Parcel 4-WD, at the current southwesterly comer of a tract of land conveyed to Mifflin Township of record in Instrument Number 201711300169273, being the northwesterly comer of a 0.958 acre tract of land conveyed to Linda L. being a northerly comer of a 0.095 acre tract of land conveyed to the State of Ohio of record in Official Record 12459B10 and being in the northerly right-of-way line of U.S. Route 62 (R/W-Varies) as established on FRA-62-19.06;

Thence S 17° 56' 20" W, along the southeasterly line of the remainder piece of said Original 7 .3695 acre tract, along the westerly line of said 0.095 acre tract and along said northerly right-of-way line, 217.2± feet to a common comer thereof and being in the northerly line of a 0.348 acre tract of land conveyed to the State of Ohio of record in Deed Book 3187, Page 412;

Thence S 44° 26' 25" W, continuing along the southerly line of the remainder piece of said Original 7.3695 acre tract, along the northerly line of said 0.348 acre tract, along a portion of the northerly line of a 0.036 acre tract of land conveyed to the State of Ohio of record in Deed Book 3116, Page 84 and along said northerly right-of-way line, 322.2± feet to an angle point, being the southwesterly comer of the remainder piece of said Original 7.3695 acre tract and being in the easterly line of said 0.958 acre tract;

Thence N 02° 46' 47" E, along the westerly line of the remainder piece of said Original 7.3695 acre tract, along the easterly line of said 0.958 acre tract, 30.7± feet to an angle point at the northeasterly comer of said 0.958 acre tract and the southeasterly comer of said Mifflin Township tract;

Thence N 86° 31' 14" E, along the southerly line of said Mifflin Township tract, along the northerly line of said 0.958 acre tract, 435.8± feet to the True Point of Beginning. Containing 14.0± acres.

The above description was prepared by Advanced Civil Design Inc. on March 25, 2025 and is based on information obtained from the Franklin County Auditor's Office and Franklin County Recorder's Office.

The total length of the annexation perimeter is 4,658± feet, of which 720± feet are contiguous with existing City of Columbus Corporation lines, being 15.5±% contiguous.

SECTION 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.

SECTION 3That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
