Rezoning Application: Z23-018

 

APPLICANT:  Eric D. Martineau; 3006 North High Street, Suite 1A; Columbus, OH 43202.

 

PROPOSED USE:  Multi-unit residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0) on June 8, 2023.

 

5TH BY NORTHWEST AREA COMMISSION RECOMMENDATION: Approval.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval. The 0.16± acre site consists of one undeveloped parcel zoned in the R, Rural District as the result of a 2020 annexation from Clinton Township. The requested AR-1, Apartment Residential District will permit a multi-unit residential development at this location. The site is within the boundaries of the 5th by Northwest Neighborhood Plan (2009), which recommends “Mixed Use” land uses at this location. The Plan also includes the adoption of the Columbus Citywide Planning Policies (C2P2) Design Guidelines (2018). A concurrent Council Variance (Ordinance #1951-2023; CV23-032) has been submitted to permit two, two-unit dwellings on one lot, and includes variances for AR-1 district permitted building arrangement, lot width, building setback, parking lot screening, side and rear yards, and fronting. The proposed development is consistent with the established development pattern along Chesapeake Avenue.

WHEREAS, application #Z23-018 is on file with the Department of Building and Zoning Services requesting rezoning of 0.16± acres from R, Rural District, to AR-1, Apartment Residential District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the 5th by Northwest Area Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the requested AR-1, Apartment Residential District is consistent with the land use recommendations of the 5th by Northwest Plan, and is compatible with the surrounding zoning and development pattern; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

1480 CHESAPEAKE AVE. (43212), being 0.16± acres located on the north side of Chesapeake Avenue, 500± feet east of North Star Avenue, and being more particularly described as follows:

 

Situated in the State of Ohio, County of Franklin, and in the City of Columbus and is bounded and described as follows:

 

Being Lot Number 46, of LINCOLN HEIGHTS SUBDIVISION, as the same is numbered and delineated upon the recorded plan thereof, of record in Plat Book 7, Page 250, Recorder’s Office, Franklin County, Ohio.

SECTION 3.  That the Director of the Department of Building and Zoning Services be, and is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Department of Building and Zoning Services.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
