Explanation
1. BACKGROUND:
This ordinance will authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Livingston Avenue Sewer Improvements Project.
2. FISCAL IMPACT:
The funds being transferred herein, are residual project funds that are no longer required. There will be sufficient budget authority within the 2004 Capital Improvements Budget upon passage of this ordinance.
3. EMERGENCY DESIGNATION:
The Division of Sewerage and Drainage is hereby requesting Columbus City Council to declare this ordinance to be an emergency measure in order to allow for the immediate commenement of acquiring the easements necessary to construct this project which the Division is required to construct under the terms of a consent order between the City of Columbus and the State of Ohio.

WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities, has developed construction plans and specifications for the sanitary sewer improvement projects known as the Livingston Avenue Sewer Improvements Project; and
WHEREAS, in order to construct the aforementioned sanitary improvements it has been determined necessary for this City Council to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary to complete said acquisition; and
WHEREAS, an emergency exists in the usual daily operation of the Division of Sewerage and Drainage, Department of Public Utilities, in that it is immediately necessary to authorize the appropriation, transfer and expenditure of funds; to amend the 2004 Capital Improvements Budget; pursuant to authorizing the City Attorney to procure the required easements necessary to construct the aforementioned vital sanitary sewer improvements; for the preservation of the public health, peace, property and safety; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
Section 1. That the City Auditor is hereby authorized and directed to appropriate a total of $75,000.00 within the 1991 Voted Sanitary Bond Fund No. 664 as follows:

Section 2. That the City Auditor is hereby authorized and directed to transfer $75,000.00 from within the 1991 Voted Sanitary Bond Fund No. 664, for the Division of Sewerage and Drainage as follows:

Section 3. That the City Auditor is hereby authorized and directed to transfer any unencumbered balance in the project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project; except that no transfer shall be so made from a project account funded by monies from more than one source.
Section 4. That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Livingston Ave. Sanitary Sewer Improvements Project.
Section 5. That the expenditure of $75,000.00, or so much thereof as may be necessary is hereby authorized within the Division of Sewerage and Drainage No. 60-05| from the 1991 Voted Sanitary Bond Fund No. 664| Livingston Ave. Sanitary Sewer Imp. Project| Proj. No. 650635| OCA Code 642918| Object Level Three No. 6601.
Section 6. That the 2004 Capital Improvements Budget Ordinance No. 1059-2004 is hereby amended as follows, in order to provide sufficient budget authority for the City Attorney to acquire the easement necessary to successfully construct the subject sanitary sewer infrastructure:

Section 7. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
