Explanation
This ordinance is submitted to settle the lawsuit known as James G. Jackson v. the City of Columbus, Franklin County Court of Common Pleas Case No. 01CVC-07-6875.
Funds were not specifically budgeted for this settlement; however, sufficient monies are currently available in the appropriate account to pay the amount of these claims.
Title
To authorize and direct the City Attorney to settle the lawsuit of James G. Jackson v. the City of Columbus, Franklin County Court of Common Pleas Case No. 01CVC-07-6875 and to authorize the expenditure of the sum of Forty-two Thousand Seven Hundred Sixty Dollars and Thirty-Two Cents ($42,760.32) in the settlement of this lawsuit for wages, and pension and workers' compensation costs associated with the wages, and to declare an emergency.
Body
WHEREAS: James G. Jackson has filed a lawsuit against the City of Columbus and Thomas W. Rice, Sr., alleging that he was defamed; and,
WHEREAS: The parties have entered into a settlement agreement; and,
WHEREAS: The City of Columbus has agreed to reimburse James G. Jackson for 55 days of vacation time taken by James G. Jackson in the Fall of 1996; and,
WHEREAS: It is in the best interests of the City of Columbus to settle this case for the amount of Thirty-two Thousand Two Hundred Forty-seven Dollars and Sixty Cents ($32,247.60), which represents the reimbursement for 55 days of vacation time used by James G. Jackson and Ten Thousand Five Hundred Twelve Dollars and Seventy-two cents in pension and workers' compensation costs associated with the wages ($10,512.72) for a total of Forty-Two Thousand Seven Hundred Sixty Dollars and Thirty -Two cents ($42,760.32); and,
WHEREAS: By reason of the foregoing an emergency exists in the usual daily operation of the City and it would be in the City's best interest to compromise and settle this matter and for further preservation of the public health, peace, property, safety, and welfare:
Now, Therefore,
Be it ordained by the Council of the City of Columbus
SECTION 1: That the City be, and hereby is, authorized and directed to settle the lawsuit of James G. Jackson v. The City of Columbus, Franklin County Court of Common Pleas Case No. 01CVC-07-6875 by the payment of Thirty-two Thousand Two Hundred Forty-seven Dollars and Sixty Cents ($32,247.60) in wages and Ten Thousand Five Hundred Twelve Dollars and Seventy-two cents ($10,512.72) in fringe benefits associated with the settlement ;
SECTION 2: That for the purposes of paying this settlement there be, and hereby is, authorized to be expended by the City of Columbus, from Department of Public Safety, Division of Police. Division No. 3003, Fund 010, OCA Code 301366 as follows:

TOTAL $42,760.32
SECTION 3: That the City Auditor be, and hereby is, authorized to draw a paycheck in the amount of $32,247.60 payable to James G. Jackson, upon receipt of a Release approved by the City Attorney.
SECTION 4: That for the reasons stated in the preamble hereto, which is made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten day after passage if the Mayor neither approves nor vetoes the same.
