FAR EAST AREA COMMISSION RECOMMENDATION: Approval.
CITY DEPARTMENTS' RECOMMENDATION: Approval. The site consists of a single-unit dwelling in the R-1, Residential District. The requested Council variance will allow the site to be used as a shared living facility with a maximum of six residents. A Council variance is required because a shared living facility with six occupants is not allowed in the R-1 zoning district. A variance to reduce required parking from seven to four spaces is included in the request. The site is within the planning boundaries of the Far East Land Use Plan (2018) which recommends “Very Low Density Residential (<4 du/ac)” land uses for this location. Staff supports the proposed use as it does not change the physical characteristics of the dwelling, maintains the residential nature of the property, and does not introduce an incompatible use to the area.

To grant a Variance from the provisions of Sections 3332.033, R-1, residential district; and 3312.49(C), Required Parking, of the Columbus City Codes; for the property located at 1930 WALNUT HILL PARK DR. (43232), to allow a shared living facility with reduced parking in the R-1, Residential District (Council Variance #CV26-037).

WHEREAS, by application #CV23-037, the owner of property at 1930 WALNUT HILL PARK DR. (43232), is requesting a Council variance to permit a shared living facility with reduced parking in the R-1, Residential District; and
WHEREAS, Section 3332.035, R-1, residential district, prohibits shared living facilities, while the applicant proposes to permit a shared living facility with up to 6 occupants; and
WHEREAS, Section 3312.49(C), required parking, requires one parking space per 400 square feet, for a total of seven required spaces, while the applicant proposes to maintain four parking spaces; and
WHEREAS, the Far East Area Commission recommends approval; and
WHEREAS, the City Departments recommend approval because the proposal would not introduce an incompatible use to the area; and
WHEREAS, said ordinance requires separate submission for all applicable permits, licenses, and a Certificate of Occupancy for the proposed shared living facility; and
WHEREAS, said variance will not adversely affect the surrounding property or surrounding neighborhood; and
WHEREAS, the granting of said variance will not impair an adequate supply of light and air to adjacent properties or unreasonably increase the congestion of public streets, or unreasonably diminish or impair established property values within the surrounding area, or otherwise impair the public health, safety, comfort, morals, or welfare of the inhabitants of the City of Columbus; and
WHEREAS, the granting of said variance will alleviate the difficulties encountered by the owners of the property located at 1930 WALNUT HILL PARK DR. (43232), in using said property as desired; now, therefore:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That a variance from the provisions of Sections 3332.033, R-1, residential district; and 3312.49(C), Required parking, of the Columbus City Codes, is hereby granted for the property located at 1930
WALNUT HILL PARK DR. (43232), insofar as said sections prohibit a shared living facility for 6 occupants in the R-1, Residential District, with a parking space reduction from seven required spaces to four spaces; said property being more particularly described as follows:
1930 WALNUT HILL PARK DR. (43232), being 0.60± acres located on the east side of Walnut Hill Park Drive, 650± feet south of Saranac Drive, and being more particularly described as follows:
Situated in the City of Columbus, County of Franklin, State of Ohio:
Being Lot Number Seven (7) of WALNUT HILL PARK, as the same is numbered and delineated upon the recorded plat thereof as recorded in Plat Book 41, Page 36, Recorder’s Office, Franklin County, Ohio.

SECTION 2. That this ordinance is conditioned on and shall remain in effect only for so long as said property is used for a shared living facility with a maximum of 6 occupants, or those uses permitted in the R-1, Residential District.
SECTION 3. That this ordinance is further conditioned on the applicant obtaining all applicable permits, licenses, and a Certificate of Occupancy for the proposed shared living facility.
SECTION 4. That this ordinance is further conditioned on the applicant filling in the existing pool located on the property, and a maximum of six residents will be allowed to reside in the shared living facility at any given time.
SECTION 5. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
