Explanation

 

1.  BACKGROUND:

In a continued effort to improve operational efficiencies, provide better services to the public, and to streamline government organization and communication, it was determined that the Department of Public Services needs to make updates to the existing Chapter 904 of Title 9 - Streets, Parks and Public Properties Code of Columbus City Code 1959, as amended.

 

The purpose of this legislation is to enact, amend and repeal various sections of Title 9 - Streets, Parks and Public Properties Code of the Columbus City Code, 1959, as amended that addresses City policy related to the issuance and renewal of leases under Chapter 904 as well as addressing the policy to maximize the available space for pedestrian movement within the sidewalk and other similar public rights-of-way particularly for people with disabilities utilizing public sidewalks and curb ramps.

 

2.  FISCAL IMPACT:

There is no direct fiscal impact associated with this code change.

 

Title

WHEREAS, in a continued effort to improve operational efficiencies, provide better services to the public, and to streamline government organization and communication, it was determined that the Department of Public Services needs to make updates to the existing Chapter 904 and Chapter 908 of Title 9 - Streets, Parks and Public Properties Code of Columbus City Code 1959; and

 

WHEREAS,  the purpose of this legislation is to enact, amend and repeal various sections of Title 9 - Streets, Parks and Public Properties Code of the Columbus City Code, 1959, as amended that addresses City policy related to the issuance and renewal of leases under Chapter 904 as well as addressing the policy to maximize the available space for pedestrian movement within the sidewalk and other similar public rights-of-way particularly for people with disabilities utilizing public sidewalks and curb ramps; and NOW, THEREFORE

 

WHEREAS, an emergency exists in the usual daily operation in the City of Columbus in that it is immediately necessary to pass this ordinance due to the imminent termination of the City’s contract with our current bikeshare provider (Lyft) for the immediate preservation of the public peace, property, health and safety; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That Chapter 904, Sections 904.01 and 904.04 of Title 9 - Streets, Parks and Public Properties Code, Café Seating, Banners and Non-Permanent Amenities Installed within Public Rights-of-Way, is hereby amended as follows per the attached word document

SECTION 2.  That existing Sections 904.01 and 904.04 of the Columbus City Codes are hereby repealed.

 

SECTION 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.

SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or 10 days after its passage if the Mayor neither approves nor vetoes the same.
