AN07-003
BACKGROUND: This ordinance is submitted to present to Council the transcript of proceedings and papers relating to Annexation AN07-003 a certain petition for annexation as described in the ordinance which is attached hereto. More than sixty days have elapsed since May 23, 2007, the date of receipt from the Board of County Commissioners of Franklin County.
These are submitted in accordance with the Ohio Revised Code.
FISCAL IMPACT: Provision of municipal services for a proposed annexation area has no fiscal impact. However, provision of the stated services does represent cost to the city. The annexation of land also has the potential to create revenue to the city.
Title
To accept the application (AN07-003) of Columbus Municipal Airport Authority for the annexation of certain territory containing 9.014 ± Acres in Mifflin Township.
Body
WHEREAS, a petition for the annexation of certain territory in Mifflin Township was duly filed by Columbus Municipal Airport Authority on April 11, 2007; and
WHEREAS, the said petition was duly considered by the Board of County Commissioners of Franklin County, Ohio, and the annexation of said hereinafter described territory to the city of Columbus was approved by said Commissioners by order dated May 15, 2007; and
WHEREAS, the Board of County Commissioners of Franklin County certified the transcript of the proceedings in connection with the said annexation with the map and petition required in connection therewith to the City Clerk who received the same on May 23, 2007; and
WHEREAS, sixty days from the date of said filing have now elapsed in accordance with the provisions of the Ohio Revised Code; and
WHEREAS, it is in the best interest of the city of Columbus to accept the annexation of the territory sought to be annexed by the aforesaid petition; now, therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That the proposed annexation as applied for in the petition of Columbus Municipal Airport Authority being the majority of owner(s) of real estate in the territory sought to be annexed and filed with the Board of County Commissioners of Franklin County, Ohio in which said petition prayed for annexation to the city of Columbus, Ohio, of certain territory adjacent thereto as hereinafter described, and which said petition was approved for annexation to the city of Columbus by the Board of County Commissioners by order dated , be and the same is hereby accepted and said territory is hereby annexed to the city of Columbus. Said territory is described as follows:
Situated in Section Qtr. Twp. 3, Township 1 North, Range 17 West, U.S.M.L., Township of Mifflin, County of Franklin, State of Ohio, and being all of the land known as Elmhurst Extension Blocks P, Q, R and S as shown on the plat recorded in Plat Book 19, page 35 and a part of land conveyed to Columbus Municipal Airport Authority (Parcel 190-000014) by deed as recorded in Instrument Number 200603240055098 (all references to deeds, microfiche, plats, surveys, etc. refer to the records of the Franklin County Recorders Office, unless noted otherwise) and being more particularly bounded and described as follows:
Beginning at the intersection of the north right-of-way line of Seventeenth Avenue (80' wide per Road Record 16, page 233) with the east right-of-way line of Ethel Avenue (50' wide per Plat Book 19, page 35);
thence in a northerly direction along the east right-of-way of said Ethel Avenue for a distance of approximately seven hundred twenty three feet (723'±) to the northwest corner of said Elmhurst Addition;
thence in an easterly direction along the north line of said Elmhurst Addition, passing a corner of the existing corporation line of the City of Columbus, as established by Ordinance 774-66 and recorded in Miscellaneous Book 140, page 561 at approximately two hundred thirty-four feet (234'±) for a total distance of approximately five hundred forty-four feet (544'±) to the northeast corner of said Elmhurst Addition;
thence in a southerly direction along the east line of said Elmhurst Addition across said land conveyed to Columbus Municipal Airport Authority and along the west line of Parcel 010-146775 for a distance of approximately seven hundred twenty-two feet (722'±) to a point on the north right-of-way line of said Seventeenth Avenue;
thence in a westerly direction along the north right-of-way line of said Seventeenth Avenue for a distance of approximately five hundred forty-four feet (544'±) to the POINT OF BEGINNING, containing approximately 9.01 acres, more or less.
Section 2. That the City Clerk is hereby authorized and directed to make three copies of this ordinance to each of which shall be attached a copy of the map accompanying the petition for annexation, a copy of the transcript of proceedings of the Board of County Commissioners relating thereto, and a certificate as to the correctness thereof, the City Clerk shall then forthwith deliver one copy to the County Auditor, one copy to the Board of Elections thereof and do such other things as may be required by law.
Section 3. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
