Title: To authorize the Director of Finance and Management to establish a purchase order with National Restaurant Association Solutions, LLC for the purchase of SERVSAFE textbooks for Columbus Public Health, to authorize the expenditure of $35,000.00 from the Health Special Revenue Fund to pay the cost thereof; to waive provisions of competitive bidding; and to declare an emergency. Explanation
BACKGROUND:      Since 1998, Columbus Public Health (CPH) has provided a Food Service Managers Food Safety Certification Course called SERVSAFE.  SERVSAFE is a product of the National Restaurant Association Education Foundation (NRAEF).  The course provides operators of food businesses with the information necessary to serve safe, wholesome foods to their customers.  CPH provides this course to the food industry through on-staff instructors on a monthly basis.  Because of this outreach, a strong and positive relationship has been developed between the industry and the Food Safety Program at CPH.  In 2010, a Universal Term Contract was established for the purchase of the textbooks for this program.  In October, 2012, CPH received a price quote from the publisher of the SERVSAFE materials, National Restaurant Association Solutions, LLC (NRA).  It has been determined that by working directly with the publisher of the training materials, it will lower CPH's costs since NRA's pricing is significantly less than what was bid on the existing UTC.  Due to time constraints and the potential to substantially reduce costs, formal bids were not solicited.  Therefore, this ordinance waives competitive bidding provisions.  This ordinance authorizes the Director of Finance and Management to establish a purchase order with National Restaurant Association Solutions, LLC for the purchase of SERVSAFE textbooks needed for upcoming classes.  
 
Emergency action is requested to ensure an adequate supply of textbooks to be available for upcoming SERVSAFE classes.  National Restaurant Association Solutions, LLC's contract compliance number is 204495726, which is effective through October 19, 2014.  
 
FISCAL IMPACT:  Monies for this purchase order were budgeted in the Health Special Revenue Fund for fiscal year 2012.  The Health Special Revenue Fund is reimbursed for this expense through fees paid by participants of the SERVSAFE course.

WHEREAS, Columbus Public Health provides a Food Service Managers Food Safety Certification Course called SERVSAFE; and,
WHEREAS,  Columbus Public Health is in need of textbooks for upcoming SERVSAFE classes; and,
WHEREAS,  National Restaurant Association Solutions, LLC provides textbooks for Food Safety courses; and,
 
WHEREAS, an emergency exists in the usual daily operation of the Columbus Public Health in that it is immediately necessary to enter into a purchase order with National Restaurant Association Solutions, LLC for the immediate preservation of the public health, peace, property, safety and welfare, and to ensure a sufficient supply of textbooks for upcoming SERVSAFE classes; Now, therefore,
      BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1.  That the Director of Finance and Management is hereby authorized to establish a purchase order with National Restaurant Association Solutions, LLC for the purchase of SERVSAFE textbooks.
SECTION 2. That the total expenditure of $35,000.00 is hereby authorized from the Health Special Revenue Fund, Fund No. 250, Department of Health, Department No. 50-01, Object Level One 03, Object Level Three 3427, OCA Code 500934.
SECTION 3. That the provisions of Section 329.11 of the Columbus City Code are hereby waived.  See attachment:  waivernationalrestaurantassoc12.doc.
SECTION 4.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 5.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
