Explanation
 
Background: The City and the State, acting through the Ohio Arts and Sports Facility Commission, entered into a Lease Agreement dated September 29, 1995 for the lease of the former Central High School site, which was authorized by City Council by Ordinance No. 1491-94, passed on July 18, 1994.  As a condition of the ordinance and subsequent lease, City Council must approve certain uses of the leased premises by ordinance.  COSI Columbus, which manages the property for the State, desires the City's approval to use the premises for a broadcast production facility.  The broadcast facility to be operated by WOSU will serve dual purpose of providing space for WOSU and as an exhibition of a working radio and television station for the science and industry museum.  This legislation authorizes and permits the leased premises to be used as a site for a WOSU broadcast production facility and to consent to those improvements necessary to locate the broadcast production facility onto the COSI premises.
 
Fiscal Impact:  N/A
 
Emergency Justification:  Emergency action is request to allow for the immediate construction of the aforementioned facility.
 
Title
 
To provide the City's consent under the lease between the City and the State of Ohio for the former Central High School site to use a portion of the premises for a radio and television broadcast production facility operated by WOSU, and to consent to those improvements necessary to locate the radio and television broadcast production facility within the premises and to declare an emergency.
 
Body
 
WHEREAS,      the City of Columbus and the State of Ohio (acting through the Ohio Arts and Sports Facility Commission) entered into a certain Lease Agreement dated September 29, 1995 for the lease of the former Central High School site; and
 
WHEREAS,      the lease was authorized by the Columbus City Council by Ordinance No. 1491-94, passed on July 18, 1994
 
WHEREAS,      as a condition of the ordinance and subsequent lease, City Council must approve any changes in uses of the leased premises not originally contemplated and set forth in Ordinance No. 1491-94 and the lease; and
 
WHEREAS,      the State desires City Council's approval to allow WOSU to build a 12,000 square foot radio and television broadcast production facility within the leased premises, designed so that visitors can see the broadcast facility in action, providing the public with a hands-on media-related educational opportunity; and
 
WHEREAS,      an emergency exists in the usual daily operation of the City of Columbus, in that it is immediately necessary that City Council consents to the proposed use and to consent to those improvements necessary to locate the radio and television broadcast facility onto the leased premises in order to meet the schedule requirements for construction of the improvements which are for the immediate preservation of the public health, peace, property and safety; now, therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
      Section 1.      That City Council hereby, consents to the use of a portion of that City owned real property known as the Center of Science and Industry as a site for a WOSU radio and television broadcast production facility, and that City Council hereby consents to those improvements necessary to locate the broadcast production facility onto the COSI premises.
 
 
      Section 2.      That for the reasons state in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after its passage if the Mayor neither approves nor vetoes the same.
