Explanation

 

BACKGROUND:  The purpose of this legislation is to authorize the Director of Finance and Management on behalf of the Director of Public Utilities to enter into a contract with Americas Generators, Inc. for the purchase of one (1) Portable Standby Generator with Trailer to be used at the Division of Water’s Control Center.  This equipment is utilized by the Control Center to maintain pumping operations at Booster Stations in the event of a power outage.  It can also be used to backup any of the stationary generators at the critical pumping stations or the generator at 910 Dublin Road. This purchase was approved by Fleet and unit will replace Brass Tag# 16520.

The Purchasing Office advertised and solicited competitive bids in accordance with the relevant provisions of City Code Chapter 329 relating to competitive bidding (RFQ026759).  Six hundred and ninety nine (699) bidders were solicited and two (2) bids (MAJ) was received and opened on February 22, 2024. 

 

The Division of Water recommends an award be made for all items to Americas Generators, Inc. in the amount of $159,990.00 as the lowest responsive and responsible bidder.

 

EMERGENCY DESIGNATION:  This ordinance is being submitted as an emergency due to the rising costs, short ordering window and long lead times for equipment delivery.

 

SUPPLIER:  Americas Generators, Inc., Vendor# 048063, Expires 2/8/2026.

 

The company is not debarred according to the Excluded Party Listing System of the Federal Government or prohibited from being awarded a contract according to the Auditor of State Unresolved Findings for Recovery Certified Search.

 

FISCAL IMPACT:  $175,990.00 (which includes a contingency fund of $16,000.00) is budgeted for this purchase.

Body

 

WHEREAS, The Portable Standby Generator with Trailer is utilized by the Control Center to maintain pumping operations at Booster Stations in the event of a power outage; and

 

WHEREAS, the Purchasing Office opened formal bids on February 22, 2024 for the purchase of a Portable Standby Generator with Trailer for the Division of Water’s Control Center; and

 

WHEREAS, the Division of Water recommends an award be made to the lowest responsive and responsible bidder, Americas Generators, Inc.; and

 

WHEREAS, it is necessary to authorize the expenditure of up to $175,990.00 from the Water Operating Fund; and

 

WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Water, in that it is immediately necessary to authorize the Director of Finance and Management to associate all General Budget Reservations resulting from this ordinance for the purchase of one Portable Standby Generator with Trailer with Americas Generators, Inc. due to rising costs, short ordering window and long lead times for equipment delivery, all for the immediate preservation of the public health, peace, property, safety and welfare; and NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Director of Finance and Management be and is hereby authorized to enter into a contract with Americas Generators, Inc. for the purchase of one (1)  Portable Standby Generator with Trailer for the Division of Water, in accordance with RFQ026759 specifications on file in the Purchasing Office.

 

SECTION 2.  That the expenditure of $175,990.00, or as much thereof as may be needed, is hereby authorized in Fund 6000 (Water Operating); in Object Class 06 Capital Outlay per the accounting codes in the attachment to this ordinance.

 

SECTION 3.  That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.

 

SECTION 4.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
