PROPOSED USE:  Manufacturing and truck-related commercial uses.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on November 13, 2003.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The requested L-M, Limited Manufacturing District for a truck equipment business allowing truck sales and service (including sales of parts) and office uses is consistent with the established development and zoning pattern of the area.

WHEREAS, application #Z03-032 is on file with the Building Services Division of the Department of Development requesting rezoning of 11.21± acres from M-1, Manufacturing District, to L-M, Limited Manufacturing District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the requested L-M, Limited Manufacturing District for a truck equipment business allowing truck sales and service (including sales of parts) and office uses is consistent with the established development and zoning pattern of the area, now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:
 
1800 WALCUTT ROAD (43228), being 11.21± acres on the east side of Walcutt Road, 1530± feet north of Trabue Road, and being more particularly described as follows:
 
Situated in the County of Franklin, State of Ohio, Being a part of survey No. 5244, Virginia Military District, being more particularly described as follows:
 
TRACT 1
Beginning at a point in the center line of Walcutt Road S. 13 degrees 35' W. 281.2 feet from an angle point, said angle point being located at the northwest corner of an 11.21 acre tract owned by Harry Butler; thence through the 11.21 acre tract N. 83 degrees 11' E. 852 feet to a point in the cast line of said tract; thence S. 14 degrees 25' W. 333.87 feet to a stake in the southeast corner of the 11.21 acre tract; thence S. 83 degrees 11' W. 845.65 feet to the center line of Walcutt Road; thence with the center line of said road N. 13 degrees 35' E. 333.8 feet to the place of beginning, containing 5.71 acres more or less.

Beginning at an angle point in the center line of Walcutt Road, said beginning point also being the northwest corner on an 11.21 acre tract, formerly owned by Harry Butler; thence N. 83 degrees 11' E. 854.4 feet to a stake, passing an iron pipe at 21.96 feet; thence S. 14 degrees 25' W.  281.2 feet to a point; thence on a line parallel to the north line, S. 83 degrees 11' W. 852 feet to a point in the center line of Walcutt Road N. 13 degrees 35' E. 281.2 feet to the place of beginning, containing 5.5 acres more or less.

SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established on the L-M, Limited Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved L-M, Limited Manufacturing District and Application among the records of the Building Services Division as required by Section 3370.03 of the Columbus City Codes; said text being titled "LIMITATION TEXT", signed by David Murphy, agent for the applicant, dated October 1, 2003, and reading as follows:

1.  INTRODUCTION:
 
The 11.21+ acre site is zoned in the M-1 Manufacturing District and developed with a truck equipment manufacturing shop and office.  In addition, there is a temporary office trailer used as a contractor's office, a truck sales lot, and a single-family dwelling used as a night watchman's house.
 
 
2.  PERMITTED USES:
 
A.  Uses set forth in Section 3363.01 are limited to the following:
 
1.  New and Used Truck Sales, Rental and Leasing
2.  Truck Maintenance, Repair and Installation
3.  Sales of Truck Accessories, Equipment and Parts
4.  Office uses as set forth in C-2, Commercial District Section 3353.03 A-E
5.  A dwelling unit for a resident security person  
 
B.  All uses permitted in Sections 3363.02-3363.16.
            
                                    
3.  DEVELOPMENT STANDARDS:  Unless otherwise indicated, the applicable development standards are contained in Chapter 3363 M, Manufacturing District of the Columbus City Code.
 
A.  Density, Height, Lot and/or Setback Commitments.
 
Any new parking or buildings added to the site will be setback sixty (60) feet from Walcutt Road.
 
B.  Access, Loading, Parking, and/or Other Traffic Related Commitments.
 
Any and all circulation, curb cuts and access points not already existing shall be designated and located to the specifications of the City of Columbus Transportation Division.
 
C.  Buffering, Landscaping, Open Space and/or Screening Commitments.
 
Existing mature trees will be maintained along with the current building and parking setback.
 
D.  Building Design and/or Interior-Exterior Treatment Commitments.

E.  Lighting, Outdoor Display Areas, and/or other Environmental Commitments.
 
All external outdoor lighting fixtures shall be from the same or similar manufacturer type/style to promote compatibility.
                                                                  
F.  Graphics and/or Signage Commitments.
 
All graphics and signage shall comply with the Graphics Code, Article 15, Title 33, of the Columbus City Code as it applies to M, Manufacturing District, and any variance from those requirements will be submitted to the City of Columbus Graphics Commission for consideration.
 
SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established in the L-M, Limited Manufacturing District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
