Title: To authorize and direct the Finance Director to modify past, present and future purchase orders with Capital Refuse Consultants, L.L.C. and to declare an emergency.
 
Explanation
 
BACKGROUND:  To change the company name and Federal Identification number for contract number FL001848 for the purchase of Eight (8) Cubic Yard Front Loading Refuse Containers for the Purchasing Office.  This ordinance authorizes the assignment of all past, present and future business done by the City of Columbus with Capital Refuse Consultants L.L.C., Inc. FID 311243977 to Capital Resources Consultants, L.L.C. FID 542108696.
 
1. Amount of additional funds:  No additional funds are necessary to modify the option contract.
2. Reason additional needs were not foreseen: The current supplier merged with another company.
3. Reason other procurement processes not used: The same exact product is required as originally bid. No lower pricing/more attractive terms and conditions are anticipated through rebidding at this time.
4. How cost was determined:  Terms and conditions are in accordance with the original agreement.
 
FISCAL IMPACT: No additional is required to modify the option contract. Each agency must set aside their own funding for their estimated expenditures.
 
In order to maintain an uninterrupted of services to City agencies using this Universal Term Contract, this ordinance is being submitted as an emergency.
 
 
Title
 
To authorize and direct the Finance Director to modify past, present and future purchase orders with Capital Refuse Consultants, L.L.C. and to declare an emergency.
 
Body
 
WHEREAS, the Finance/Purchasing Office established the contract with Capital Refuse Consultants L.L.C. for the option to purchase Eight (8) Cubic Yard Front Loading Refuse Containers; and
 
WHEREAS, Capital Refuse Consultants L.L.C. changed its name to Capital Resources Consultants L.L.C., in addition to notifying the City of the name change, Capital Resources Consultants L.L.C. has agreed to honor the past, present and future purchase orders established from contract number FL001848, and
 
WHEREAS, these refuse containers are necessary to keep the City of Columbus, beautiful and free of debris, therefore this measure is being pursued as an emergency, and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Refuse Collection Division in that it is immediately necessary to modify contract number FL001848, thereby preserving the public health, peace, property, safety, and welfare, now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1. That the Finance Director be and is hereby authorized and directed to modify contract FL001848 and all past, present and future purchase orders pursuant to that contract to reflect the change of the company name and FID number from Capital Refuse Consultants L.L.C. #311243977 to Capital Resources Consultants, #542108696.
 
SECTION 2. That this modification is in accordance with Section 329.16 of the Columbus City Codes.
 
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
