Explanation
This ordinance authorizes the City Clerk to enter into a licensing or assignment agreement with Jonathan Barnes Architecture and Design for architectural drawings created for the City Accessory Dwelling Unit Pilot to allow for the drawings to be assigned, delegated, sublicensed, pledged and/or transferred in furtherance of the Accessory Dwelling Pilot
Emergency action is requested to take ownership of the plans before Jonathan Barnes Architecture and Design officially closes its doors at the end of the year.
Title
To authorize the City Clerk to enter into a licensing or assignment agreement with Jonathan Barnes Architecture and Design for the City Accessory Dwelling Unit Pilot and to declare an emergency.
Body
WHEREAS, City Council engaged Jonathan Barnes Architecture and Design for the purpose of creating building plans for Council’s Accessory Dwelling Unit Pilot; and
WHEREAS, an architect retains all rights to any drawing created by the architect unless the architect expressly conveys those right to another party; and
WHEREAS, the City wishes to obtain the right to assign, delegate, sublicense, pledge and/or transfer the drawings in furtherance of the Accessory Dwelling Pilot; and
WHEREAS, Jonathan Barnes Architecture and Design wishes to afford the City the authority to assign, delegate, sublicense, pledge and/or transfer the drawings in furtherance of the Accessory Dwelling Pilot; and
WHEREAS, an emergency exists in the daily operations of the City Clerk’s office as Jonathan Barnes Architecture and Design officially closes its doors at the end of the year; NOW THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Clerk is hereby authorized to enter into a licensing or assignment agreement with Jonathan Barnes Architecture and Design for the architectural drawings created for the City Accessory Dwelling Unit Pilot.
SECTION 2. That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared an emergency measure and shall take effect and be enforced from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
