Explanation
 
The purpose of this ordinance is to authorize the Director of Public Utilities to enter into a service agreement with Thermo Labsystems Inc for Customer Support Services for the LabManager iLMS system at the Division of Sewerage and Drainage Surveillance Laboratory in accordance with Columbus City Code Section 329.07 (c) Sole Source Procurement.  InnaPhase Corp, the designer and sole provider of the system, software and customer support service for LabManager was purchased by Thermo Labsystems Inc in December 2004. The Division of Sewerage and Drainage has been working with Thermo Labsystems Inc. to update their records on the City's procurement system. All the information needed to change the vendor file was received May 6, 2005.
 
Thermo Labsystems Inc provides support services for the custom computer system known as LabManger which is used for various applications at the Surveillance Laboratory including, analysis reports, work orders, sample processing, verification of acceptable sample ranges, and variety of other reports to enforce adherence to laboratory practices. The services provided by Thermo Labsystems Inc include, trend analysis, software support, enhancements due to technological changes, help desk support, and on-site spare system within 24 hours of failure. The period of this agreement is for one (1) year expiring in December 2005.

FISCAL IMPACT: $22,546.00 is needed and budgeted for this service.

WHEREAS, InnaPhase Corp., the designer and sole provider of the system, software and customer support service for LabManager was purchased by Thermo Labsystems Inc in December 2004 and,
 
WHEREAS, the Division of Sewerage and Drainage, Surveillance Laboratory owns the Thermo Labsystems Inc LabManager computer system, and
 
WHEREAS, the Division of Sewerage and Drainage wishes to enter into a service agreement for customer support of that system in accordance with the provisions of Columbus City Code Section 329.07 (c), Sole Source Procurement with the designer of the system and sole provider of the support service, Thermo Labsystems Inc, and,
 
WHEREAS, the service provides the Surveillance Laboratory with trend analysis, software support, enhancements due to technological changes, help desk support, and on-site spare system within 24 hours of failure and,
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage in that it is immediately necessary to enter into a service agreement so that there is not any interruption in support for the software with Thermo Labsystems Inc. for the immediate preservation of the public health, peace, property and safety; now, therefore
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1. That the Director of Public Utilities be and is hereby authorized to enter into a one (1) service agreement in accordance with the provisions of Columbus City Code Section 329.07 (c) with Thermo Labsystems Inc for Customer Support Services for the LabManager System for the Division of Sewerage and Drainage.
 
Section 2. That the expenditure of $22,546.00or so much thereof as may be needed, be and the same hereby is authorized from the Sewerage System Operating Fund, Fund No. 650, OCA 605105, Object Level 1: 03, Object Level 03: 3372.
 
Section 3. That for the reasons stated in the preamble hereto, where is hereby made a part hereof, this Ordinance is hereby declared to be an emergency measure, which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
