Explanation
 
1.      BACKGROUND:
 
A.  Need.  This legislation authorizes the Director of Public Utilities to execute a contract modification of the professional engineering services agreement with Pomeroy & Associates, Ltd. for the Lockbourne Road Sanitary Sewer Improvements Assessment Project, for the Division of Sewerage and Drainage.
 
This contract modification will fund detailed design efforts required for this project.  These activities will include plan revision due to the needed relocation of the proposed sanitary sewer; the addition of engineering services during construction; and preparation of bidding documents and specifications.  The contractor, Pomeroy & Associates, Ltd., has requested a modification amount of $39,996.00 under this ordinance.  The contract total including this modification is $127,248.50.  
 
The Division has determined that these services cannot be performed by City personnel at this time, and has planned for the procurement of these services in the project scope of services.  The work under this contract modification is a planned update to be done as part of the final plan preparation.  The modification allows for certain increased rates and fees by the Contractor due to extensive delay in the project.  During the initial design phase of this project in 2001 the Division of Transportation determined that specific roadwork had to be completed in the work area before the subject sanitary work could be properly done.  The unexpected roadwork process took approximately six years.  The adjustment in costs is reasonable to current standards and necessary to allow for the Contractor to complete their professional engineering services contract.  This legislation will additionally authorize the expenditure of funds within the Voted Sanitary Sewer Bond Fund.
 
B.      Contract Compliance No.:  CC #31-1568332 (expires February 25, 2008)
 
2.      FISCAL IMPACT:
 
This legislation includes a transfer of cash between projects within the Voted Sanitary Sewer Bond Fund and an amendment of the 2007 Capital Improvements Budget to establish sufficient funds and budget authority to cover the expenditure of $39,996.00 upon passage of this ordinance.
 
3.      PROJECT LOCATION:
 
The Lockbourne Road Sanitary Sewer Improvements Assessment Project will take place South of the 104 Highway near Lockbourne Rd. and Koebel Rd

Body
WHEREAS, Contract No. EL001546 was authorized by Ordinance No. 0996-2001, as passed by Columbus City Council on June 11, 2001 for purposes of authorizing the Director of Public Utilities to enter into a contract for professional engineering services with Pomeroy & Associates, Ltd., for the Lockbourne Road Sanitary Sewer Improvements Assessment Project; and
 
WHEREAS, the Division of Sewerage and Drainage engineering personnel have determined that it is necessary to enter into a planned modification of the subject contract in order to provide the necessary additional engineering services required for this project; and
 
WHEREAS, the Division of Sewerage and Drainage, Department of Public Utilities is requesting that this Council authorize the Director of Public Utilities to enter into a planned modification of the professional engineering services agreement with Pomeroy & Associates, Ltd., for the Lockbourne Road Sanitary Sewer Improvements Assessment Project; authorize the expenditure of necessary funds from the Voted Sanitary Sewer Bond Fund; at the earliest practical date; and
 
WHEREAS, it is necessary to authorize the transfer of monies within the Voted Sanitary Sewer Bond Fund to provide sufficient funding for the aforementioned project expenditure; and
 
WHEREAS, it is necessary to authorize and amendment to the 2007 Capital Improvements Budget for the purpose of providing sufficient spending authority for the aforementioned project expenditure; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.   That the Director of Public Utilities be, and hereby is, authorized to modify Contract No. EL001546 with Pomeroy & Associates, Ltd., 599 Scherers Court, Worthington, Ohio 43085, for the Lockbourne Road Sanitary Sewer Improvements Assessment Project, in order to provide for additional professional engineering services in accordance with the terms and conditions as shown in the contract modification on file in the office of the Division of Sewerage and Drainage.
 
Section 2.  That for the purpose of paying the cost of the professional engineering services contract modification, the following expenditure, or as much thereof as may be needed, be and the same is hereby authorized as follows:  Division 60-05; Fund 664; Lockbourne Road Sanitary Sewer Improvements Assessment Project, Project No. 650620; Object Level3 6676; OCA Code 650620; Amount $39,996.00.
 
Section 3.  That the City Auditor is hereby authorized to transfer $39,996.00 within the Voted Sanitary Sewer Bond Fund, Fund 664, Division of Sewerage and Drainage, Division 60-05, Object Level3 6676;

Section 4.  That the 2007 Capital Improvements Budget Ordinance No. 0733-2007 is hereby amended as follows, to provide sufficient budget authority for the execution of the modification stated in this ordinance:

Section 5.  That the City Auditor is hereby authorized to transfer any unencumbered balance in the project account to the unallocated balance within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies no longer required for said project; except that no transfer shall be made from a project by monies from more than one source.
 
Section 6.  That the City Auditor is authorized to establish proper project accounting numbers as appropriate.
 
Section 7.  That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 8. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
