BACKGROUND: This legislation authorizes an amendment to Ordinance No. 3292-2024, passed by Columbus City Council on December 16, 2024, to change the agreement from a non-profit service contract to a grant and to provide the option to modify and extend the agreement for one additional year.
Ordinance No. 3292-2024, authorized the Director of the Department Development to enter into a non-profit service contract with The Broad Street Presbyterian Church of Columbus Ohio in an amount up to $55,500.00 to create a fund and provide fiscal manager services, as a partner in the City of Columbus, for eligible low-income tenants facing eviction with the funding required for eviction case appeals. Funding was also authorized to be advanced on a predetermined schedule.
Emergency action is requested to prevent eviction, and potential homelessness, of City residents and families.

WHEREAS, Ordinance No. 3292-2024, passed by Columbus City Council on December 16, 2024, authorized the Director of the Department Development to enter into a non-profit service contract with The Broad Street Presbyterian Church of Columbus Ohio in an amount up to $55,500.00 to create a fund and provide fiscal manager services, as a partner in the City of Columbus, for eligible low-income tenants facing eviction with the funding required for eviction case appeals; and
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to amend Ordinance No. 3292-2024 to change the agreement from a non-profit service contract to a grant and to provide the option to modify and extend the agreement for one additional year, to assist in helping to prevent eviction and potential homelessness of City residents and families, all for the immediate preservation of the public health, peace, property, safety and welfare; and NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That Ordinance No. 3292-2004 is hereby amended as follows with deletions struck though and additions underlined:
TITLE: To authorize the Director of the Department of Development to enter into a grant agreement not-for-profit service contract with The Broad Street Presbyterian Church of Columbus, Ohio to create a fund and to provide fiscal manager services for residents appealing eviction cases in an amount up to $55,500.00; to authorize and an expenditure up to $55,500.00 from the Neighborhood Economic Development Fund; to advance funding per a predetermined scheduled; and to declare an emergency. ($55,500.00)
SECTION 2. That Ordinance No. 3292-2024 is hereby amended as follows with deletions struck through and additions underlined:
SECTION 1. That the Director of the Department of Development is hereby authorized to enter into a not-for-profit service contract grant agreement with The Broad Street Presbyterian Church of Columbus, Ohio in an amount up to $55,500.00 to create a fund and provide fiscal manager services for residents appealing eviction cases and is authorized to advance , to authorize the advancement of funds per a schedule to be included in the agreement, and to provide the option to modify and extend the agreement for one additional year.
SECTION 3. That Ordinance No. 3292-2024, Section 4, is hereby repealed as follows with deletions struck through:
SECTION 4. That this contract is awarded pursuant to the relevant provisions of Chapter 329 of City Code relating to not-for-profit service contracts.
SECTION 4. That any other provision of Ordinance No. 3292-2024 in which the legal agreement with The Broad Street Presbyterian Church of Columbus Ohio is referenced to as a “not-for-profit service contract” is intended to refer to the legal agreement as a “grant agreement”.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure which shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes it.
