Explanation
 
This ordinance authorizes the Public Service Director, on behalf of the City of Columbus, Public Service Department, Refuse Collection Division, to accept a $141,500.00 2004 "Recycle, Ohio!" grant from the Ohio Department of Natural Resources (ODNR), Division of Recycling and Litter Prevention, for continued operation of the Keep Columbus Beautiful (KCB) program in 2004.  This ODNR grant represents a significant funding source for the Keep Columbus Beautiful program that operates within the Refuse Collection Division of the Public Service Department to implement recycling, litter prevention and waste reduction education and awareness activities throughout the year.  This ordinance also appropriates these grant funds.
 
The Ohio Department of Natural Resources, Division of Recycling and Litter Prevention, requires a City match for the 2004 "Recycle, Ohio!" grant.  City matching funds in the amount of $28,300.00 are included in the pending 2004 Refuse Collection Division General Fund operating budget request.
 
Emergency action is requested to allow the division to formalize ODNR's 2004 "Recycle, Ohio" grant arrangements to allow for the uninterrupted operation of the Keep Columbus Beautiful program, and to meet payroll obligations of employees that are funded by this grant.

WHEREAS, the City of Columbus recognizes the existence of a litter problem within its boundaries and the need to address the problem at the local level, and
 
WHEREAS, the Ohio Department of Natural Resources, Division of Recycling and Litter Prevention, provides the Refuse Collection Divsion, Keep Columbus Beautiful (KCB) program, with a grant to help provide public awareness and eduction of recycling and litter prevention, and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Refuse Collection Division, in that the 2004 agreement requires legislative acceptance of this grant and authorization that the Public Service Director accept the 2004 "Recycle, Ohio!" grant funds and appropriation of the grant funds within the General Government Grant Fund for calendar year 2004, thereby preserving the public health, peace, property, safety and welfare; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That City Council hereby endorses and supports a recycling and litter prevention education and awareness program for the Public Service Department, Refuse Collection Division, Keep Columbus Beautiful program and authorizes the Public Service Director to accept a grant from the Ohio Department of Natural Resources for this purpose and execute agreements as required.
 
SECTION 2.  That the Public Service Director, Mayor, and President of City Council are hereby designated as the Authorized Officials for this grant and are thereby the official signatories.
 
SECTION 3.  The the aforesaid individuals be and hereby are authorized to execute grant agreements for this grant as may be required.
 
SECTION 4.  That from the unappropriated monies in the General Government Grant Fund, Fund 220, and from any and all monies estimated to come into said grant fund from any and all sources and unappropriated for any other purpose during the fiscal year ending December 31, 2004, the sum of $141,500.00 is hereby appropriated to the Refuse Collection Division, Department No. 59-02, Object6 Level One Code 01, Object Level Three Code 1100, OCA Code 594001 and Project 594001.
 
SECTION 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
