Explanation
 
REZONING APPLICATION:  Z06-055.
 
APPLICANT:  Rock Henderson, LLC;  c/o Tom Morris, attorney; 1900 Crown Park Court; Columbus, Ohio 43235.
      
PROPOSED USE:  Parking lot.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (6-0) on July 13, 2006.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The 0.032± acre site is developed with pavement of the parking lot from the commercial development to the east which encroaches on the subject property.  The site is approximately 247 feet long and ranges from 3.52 feet to 7.36 feet wide.  The applicant proposes to deed the site to the owner of the adjacent commercial property, however, a lot split was not allowed because a parking lot for commercial development is not a permitted use in the R-2F, Residential District.  The applicant is requesting the C-4, Commercial District, so that the property can be deeded to the adjacent commercial property owner.  The proposed development is consistent with the zoning and development patterns of the area.

WHEREAS, application #Z06-055 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.032± acres from R-2F, Residential District, to C-4, Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the proposed development is consistent with the zoning and development patterns of the area.  The 0.032± acre site is developed with pavement of the parking lot from the commercial development to the east which encroaches on the subject property.  The site is approximately 247 feet long and ranges from 3.52 feet to 7.36 feet wide.  The applicant proposes to deed the site to the owner of the adjacent commercial property, however, a lot split was not allowed because a parking lot for commercial development is not a permitted use in the R-2F, Residential District.  The applicant is requesting the C-4, Commercial District, so that the property can be deeded to the adjacent commercial property owner, now therefore:
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

LEGAL DESCRIPTION
 
.032 acre tract of land that is south of Old Henderson Road, east of Norwell Drive East and west of Kenny Road:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, being in Section 1, Township 1 North, Range 19 West, United States Military Lands, being 0.032 acres of the 0.868 acres of land conveyed to East Broad Plaza (in an instrument recorded in Vol. 7022, Page B13) and more fully described as follows:
 
Beginning for reference at an existing ¾" ID pipe in the easterly right of way of Norwell Drive East at the southwest property corner of said East Broad Plaza and the northwest corner of Norwell Addition (PB 46, Pg 79);
 
Thence South 87°40'21" East a distance of 126.51 feet, along the northerly of said Norwell Addition, to a ¾" ID pipe set being the Point of Beginning.
 
Thence North 2°45'16" East a distance of 257.41 feet to a ¾" ID pipe set in the southerly right of way of Old Henderson Road;
 
Thence South 87°39'47" East a distance of 7.36 feet, along the southerly right of way of said Old Henderson Road, to a ¾" ID pipe set in the westerly property corner of Kenny Centre LLC (Inst. No. 200104240086460);
 
Thence South 3°36'29" West A distance of 257.47 feet, along the westerly property line of said Kenny Centre LLC, to a ¾" ID pipe set in the southwesterly corner of said Norwell Addition;
 
Thence North 87°40'21" West a distance of 3.52 feet, along the northerly line of said Norwell Addition, to the Point of Beginning containing 0.032 acres more or less according to an actual field survey made by Hockaden and Associates, Inc. in March of 2006.
 
Bearings are based upon the Ohio State Plane Coordinate System South Zone 1983 Datum, Franklin County Engineer Monument "Frank 161", the centerline of Old Henderson Road bearing South 87°39'47" East and all other bearings based upon this meridian.
 
 
To Rezone From: R-2F, Residential District,
 
To: C-4, Commercial District.
 
SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established in the C-4, Commercial District on this property.
 
SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
