Explanation

The Public Service Department, Transportation Division, is engaged in a project that will upgrade, reconstruct and widen Riverview Drive from Harley Drive east approximately 2,550 feet to Olentangy River Road.  The proposed upgrades include sidewalks and an enclosed storm sewer system with curb and gutter running the entire length of the project.  The City Attorney's Office has been acquiring additional right-of-way to accommodate the proposed upgrades.  Ordinance 0385-2005 passed March 23, 2005 established preliminary funding in the amount of $123,000.00 for acquisition-related activities.  The City Attorney's Office, Real Estate Division, staff recently notified the Transportation Division that an additional $45,000.00 would be required to complete acquisition of the right-of-way needed for this project.  This legislation authorizes the City Attorney to expend an additional $45,000.00, or so much thereof as may be necessary, to complete acquisition of fee simple title and lesser interests in and to property needed for this improvement project.

 

Fiscal Impact: Additional acquisition related expenses are currently estimated to be $45,000.00 for this project.  These costs are not budgeted per se but have been identified and are available from the cancellation of $229,513.81 from an old construction contract (EL031299-002) that has been completed and for which the funds are no longer needed.  This ordinance transfers funds as appropriate between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund.

 

Emergency action is requested to allow right-of-way acquisition-related activities to continue so construction of the proposed improvement project can proceed without delay.

Body

WHEREAS, the Public Service Department, Transportation Division, is engaged in the Riverview Drive Improvement project; and

 

WHEREAS, this project will reconstruct and widen the existing uncurbed two lane Riverview Drive to 30 feet in width from Harley Drive approximately 2550 feet east to the existing Olentangy River Road; and

 

WHEREAS, also included in this project are installation of sidewalks and an enclosed storm sewer system with curb and gutter running the entire length of this project; and

 

WHEREAS, the City Attorney's office has been acquiring additional right-of-way to accommodate the proposed upgrades; and

 

WHEREAS, Ordinance 0385-2005, passed March 23, 2005, established initial funding in the amount of $123,000.00 for acquisition-related activities; and

 

WHEREAS, the City Attorney's Real Estate Division staff recently notified the Transportation Division that an additional $45,000.00 would be required to complete acquisition of the right-of-way needed for this project; and

 

WHEREAS, funds for this acquisition are not budgeted per se but have been identified and are available from the cancellation of $229,513.81 from an old construction contract (EL031299-002) that has been completed and for which the funds are no longer needed; and

 

WHEREAS, this ordinance transfers funds as appropriate between projects within the 1995, 1999, 2004 Voted Streets and Highways Fund; and

 

WHEREAS, this legislation authorizes the City Attorney to expend an additional $45,000.00, or so much thereof as may be necessary to complete the acquisition of fee simple title and lesser interests in and to property needed for this improvement project; and

 

WHEREAS, because construction plans are complete and signed, construction of this improvement project can begin as soon as right-of-way acquisition is complete; and

 

WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize the City Attorney to expend the additional funds necessary to complete acquisition-related activities for this improvement project so that construction can begin without delay, thereby preserving the public health, peace, property, safety and welfare; now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the City Auditor be and hereby is authorized to transfer $45,000.00 between projects within Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, as follows:

SECTION 2.  That the City Attorney be and hereby is authorized to continue acquisition-related activities necessary to complete acquisition of fee simple title and lesser interests in and to those parcels needed for the Riverview Drive Improvement project and to expend those funds required to pay related acquisition costs.

 

SECTION 3.  That for the purpose of paying for said costs the City Attorney's Office, Real Estate Division, be and hereby is authorized to expend $45,000.00, or so much thereof as may be necessary from Fund 704, the 1995, 1999, 2004 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 644385 and Project 530161.

 

SECTION 4.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
