BACKGROUND
This ordinance authorizes the Director of the Department of Development to waive the competitive bidding requirements of Columbus City Codes Chapter 329 and enter into a contract with Designing Local LTD, in an amount up to $15,000.00 for the purpose of pursuing private grant funding for public art and authorizes expenditures beginning July 1, 2023.
Ordinance 3467-2022, passed by City Council on December 14, 2022, authorized the Department of Development to enter into a contract with Designing Local, LTD in an amount up to $32,500.00 for the purpose of pursuing private grant funding for public art. Additional time and funding is required to sufficiently complete the work that is underway.
Ordinance 1337-2023. Passed by City Council on June 9, 2023, authorized a modification to the agreement to extend the expiration date and to add $15,000.00 to the agreement for a total of $47,500.00. However, the original agreement expired before a modification could be executed.
This legislation will authorizes the repeal of Ordinance 1337-2023.
FISCAL IMPACT: Sufficient funding is available in the Department of Development General Fund.

To authorize the Director of Development to enter into a contract, in an amount up to $15,000.00, with Designing Local, LTD. for the purpose of pursuing private grant funding for public art; to waive the competitive bidding requirements of the Columbus City Codes; to authorize expenditures beginning July 1, 2023; to authorize the expenditure of up to $15,000.00; to repeal ordinance 1337-2023. ($15,000.00)

WHEREAS, Ordinance 3467-2022, passed by City Council on December 14, 2022, authorized the Department of Development to enter into a contract with Designing Local, LTD in an amount up to $32,500 for the purpose of pursuing private grant funding for public art; and
WHEREAS, Ordinance 1337-2023, passed by City Council on June 9, 2023, authorized a modification to the agreement to extend the expiration date and to add $15,000.00 to the agreement for a total of $47,500.00; and
WHEREAS, the original agreement expired before a modification could be executed and it is now necessary to repeal Ordinance 1337-2023; and
WHEREAS, additional time and funding is required to sufficiently complete the work that is underway; and
WHEREAS, it is in the City's best interests to waive the competitive bidding requirements of City Code Chapter 329 as Designing Local, LTD as the contract modification was not executed prior to the contract expiration; and
WHEREAS, this legislation will authorize the Director of Development to enter into a contract in an amount up to $15,000.00 and to authorize expenditures beginning July 1, 2023; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That it is necessary to repeal Ordinance 1337-2023 passed June 9, 2023 authorizing the contract modification because the modification was not executed prior to the contract expiration date.
SECTION 2: That Council finds that it is in the best interest of the City to waive the competitive bidding provisions of Chapter 329 of the Columbus City Codes to enter into this contract.
SECTION 3. That the Director of Development be and is hereby authorized to enter into a contract with Designing local LTD. in an amount up to $15,000.00 and to authorize expenditures beginning July 1, 2023 to complete the work that is underway in pursuing private grant funding for public art.
SECTION 4. That for the purpose as stated in Section 1, the expenditure of $15,000.00 or so much thereof as may be needed is hereby authorized in Fund 1000 (General Fund), Dept-Div 4401 (Administration Division), object class 03 (Services) per the account codes in the attachment to this ordinance.
SECTION 5. Funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this Ordinance and the City Auditor shall establish such accounting codes as necessary.
SECTION 6. This modification is made in accordance with the relevant provisions of the City Code Charter 329 relating to contract modifications.
SECTION 7. That the City Auditor is authorized to establish such accounting codes as necessary, to make any accounting changes to revise the funding source for all agreements, contracts, or modifications associated with this Ordinance.
SECTION 8. That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
