Explanation
1.  BACKGROUND:
This legislation authorizes the Director of Public Utilities to enter into contract with Terre Hill Composites, Inc., for a test project that will allow the Division of Sewerage and Drainage to evaluate a new sewer rehabilitation product known as Multiplexx Liner PVCP System.  This contract will rehabilitate 12 manholes that are in excess of 90 years old.  
 
The Division will be evaluating two new rehabilitation products by utilizing them in the rehabilitation of 24 manholes along the Franklin Main a combined sewer located in close proximity to the Olentangy River in the Clintonville community within the City of Columbus.  The other test project will utilize the Poly-Triplex Technologies, and will be utilized in 12 manholes in the same area.  Approval for this project's Contract B-1, and other test project (B-2) is being requested under separate legislation.
      
2.  BID WAIVER INFORMATION:
Due to the nature of this contract being a test project for a new sewer rehabilitation product, the competitive procurement procedures of the Columbus City Codes cannot be fulfilled.

Body
WHEREAS, the Division of Sewerage and Drainage has identified 24 manholes along the Franklin-Main Interceptor Sewer within the Clintonville area of the City of Columbus that are in need of rehabilitation and which have been  chosen as a test project for two new sewer rehabilitation products for possible future use in the Division's capital improvements program; and
 
WHEREAS, under terms of the new product evaluation guidelines of the Division of Sewerage and Drainage, Terre Hill Composites, Inc., will apply its manhole rehabilitation product at cost, and without profit for the project identified as Franklin-Main Interceptor Sections 2 & 3 Manhole Rehabilitation Project; and
 
WHEREAS, in order to evaluate new sewer rehabilitation products, it is necessary to enter into an agreement without complying with the provisions of Section 329.06(a) of the Columbus City Codes; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Sewerage and Drainage in that it is immediately necessary to contract for the aforementioned services that are necessary to rehabilitate the 12 sanitary manholes of which several are severely deteriorated and are experiencing significant water infiltration from the Olentangy River during storm events, thereby preserving the public health, peace and safety; now, therefore,
            
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the City Auditor is hereby authorized and directed to transfer $158,010.39 from within the 1991 Voted Sanitary Bond Fund No. 664 as follows:

Section 2.  That this Council finds that it is in the best interest of the City to waive the provisions of Columbus City Code, Section 329.06(a), to authorize the Director of Public Utilities to execute a contract for sewer rehabilitation services with Terre Hill Composites, Inc., in the amount of $158,010.39, in order for the Division of Sewerage and Drainage to evaluate a new product for consideration of approving it for use in future capital improvement projects.
 
Section 3.  To authorize the Director of Public Utilities to execute a contract withTerre Hill Composites, Inc., 485 Weaverland Valley Road, Terre Hill, PA 17581, for the Franklin-Main Interceptor Sections 2 & 3 Manhole Rehabilitation Project; and to pay up to a maximum of $158,010.39 therefore.
 
Section 4.  That the expenditure of $158,010.39, or as much thereof as may be needed, be and the same is hereby authorized from the 1991 Voted Sanitary Bond Fund, within the following project:

Section 5.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
