Explanation
1. BACKGROUND
This ordinance authorizes the Director of the Department Public Service to close out the G591909 (Kingsford Road SRTS 109136) grant from the Ohio Department of Transportation (ODOT) for the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) PID 109136 project.
Ordinance 0402-2018 authorized the Director of the Department of Public Service to accept Safe Routes to School grant funds for the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) grant and execute a grant agreement with the Ohio Department of Transportation in relation to the award.
Ordinance 2617-2018 authorized the Director of the Department of Public Service to enter into a professional services contract with Korda/Nemeth Engineering for design services for the Operation Sidewalks - School Sidewalks - Hilltop contract which included the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) project.
Ordinance 0443-2022 authorized the Director of the Department of Public Service to enter into contract with Strawser Paving Company for the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) project and to provide payment for construction, construction administration and inspection services.
When completing the grant reconciliation for G591909 Kingsford Road SRTS 109136, it was determined the grant was not charged for eligible expenses for design services. Grant funds were not encumbered into the grant for the design of the Kingsford Road Sidewalks at the time of contract award to Korda/Nemeth Engineering, Inc.
This ordinance allows the Director of the Department of Public Service to complete final accounting and close grant number G591909 Kingsford Road SRTS 109136. The total amount of grant funding from ODOT is $381,899.74, of which $123,416.23 needs to be appropriated. This ordinance will also authorize the City Auditor to expenditure correct expenses from Fund 7704, P590105-100121 (Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) to the grant.
2. FISCAL IMPACT
Funds in the amount of $123,416.23 are available in Fund 7765, the Federal Transportation Grants Fund in G591909 (Kingsford Road SRTS 109136) to expenditure correct from Fund 7704, the Streets and Highways Bond Fund, P590105-100121 (Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd)). Funds in the amount of $123,416.23 need to be appropriated.
3. EMERGENCY DESIGNATION
Emergency action is requested to expedite the ability to appropriate the funds and complete necessary expenditure corrections within the current budget year.

Body
WHEREAS, the Department of Public Service completed the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) project; and
WHEREAS, Federal Transportation Grant Funds were used to pay for a portion of this project; and
WHEREAS, there is a remaining cash balance in the Federal Transportation Grants Fund; and
WHEREAS, funds in the amount of $123,416.23 must be appropriated within the Federal Transportation Grants Fund, Fund 7765; and
WHEREAS, it is necessary to authorize an expenditure correction between the Federal Transportation Grant Fund, Fund 7765 and Streets and Highways Bond Fund, Fund 7704; and
WHEREAS, expenses must be moved from the Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd) project to the Kingsford Road SRTS 109136 project; and
WHEREAS, it has become necessary in the usual daily operation of the Department of Public Service to authorize the City Auditor to appropriate funds within the Transportation Grants Fund;
WHEREAS, an emergency exists in the usual daily operation of the Department of Public Service in that it is immediately necessary to authorize the City Auditor to appropriate funds within the Transportation Grants Fund as soon as possible, to complete final accounting of the grant within the current budget year, all for the immediate preservation of the public health, peace, property, safety and welfare; and now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That from the unappropriated monies and from all monies estimated to come into said fund from any and all sources and unappropriated for any other purpose during the fiscal year ended December 31, 2024, the sum of $123,416.23 is appropriated in Fund 7765 (Federal Transportation Grants Fund), Dept-Div 5912 (Design and Construction), Project G591909 (Kingsford Road SRTS 109136) in Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.
SECTION 2. That the City Auditor be and is hereby authorized to expenditure correct $123,416.23 or so much thereof as may be needed, from Fund 7704 (Streets and Highways Bond Fund), Dept-Div 5912 (Design and Construction), Project P590105-100121 (Pedestrian Safety Improvements - Kingsford Road Sidewalks (Briggs Rd and Eakin Rd)) to Fund 7765 (Federal Transportation Grants Fund), Dept-Div 5912 (Design and Construction), Project G591909 (Kingsford Road SRTS 109136), Object Class 06 (Capital Outlay) per the account codes in the attachment to this ordinance.
SECTION 3. That funds are hereby deemed appropriated and expenditures and transfers authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
SECTION 6. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
