Explanation
OBJECTIVE: To amend Section 2903.01 of the Columbus City Codes to provide for the necessary modification of inspection fees for weighing and measuring devices used in the City of Columbus.
NEED: This amendment will allow the necessary modification of inspection fees for the inspection and testing of commercial weighing and measuring devices.
Background: As a result of a survey of fee schedules by the Office of Weights and Measures on the inspection and testing of commercial weighing and testing devices in the cities of Cincinnati, Cleveland, Philadelphia Pennsylvania, the office of Weights and Measures has proposed a modification of the fees charged by Columbus. This modification is a more realistic assessment of fee schedules in the area and would provide the revenue needed to ensure the continued maintenance of the inspection services now rendered to the public by the city.
Fiscal Impact: This legislation will increase existing fees by an average of about twenty percent and introduce four new fees. Total revenue is projected to increase by approximately $85,000.

WHEREAS, a modification of inspection fees for weighing and measuring devices used commercially in the City of Columbus is necessary for the maintenance of consumer protection in the commercial weighing and measuring area: and,
WHEREAS, it is necessary to make the modification effective as soon as possible to allow adequate time to study the potential impact of this action: and
WHEREAS an emergency exist in the usual daily operations of the Department of Public Safety, Weights and Measures section in that it is immediately necessary to amend Section 2903.01 of the Columbus City Code for the preservation of public peace, health safety and welfare: now, therefore,
BE IT ORDAIN BY THE COUNCIL OF THE CITY OF COLUMBUS
Section 1. That Section 2903.01 of the Columbus City Codes is hereby amended to read as follows
2903.01 Fees (increase)
The Sealer of Weights and Measures is authorized and directed within ten (10) days of making any test authorized by article one, to present the owner of any scales measure or other article so tested with a bill, payable upon receipt directly to the City Treasurer, for testing fees as follows:

Section 2. That the existing Section 2903.01 of the Columbus City Code be and is hereby repealed.
Section 3. That the reasons stated in the preamble hereto, which is hereby made a part; hereof this ordinance is hereby declared to take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
