Explanation
 
Background: The Lincoln Theatre, an historic landmark in the City's King-Lincoln District, is undergoing extensive renovation and is scheduled to open on April 4, 2009.  The City of Columbus has agreed to design and construct certain streetscape improvements around and near the theatre including, but not limited to, new sidewalks and curbs, a front entrance pull-off area, a Walk of Fame along Long Street in front of the theatre and pedestrian lighting. It is critical the improvements are completed during the 2008 construction season so as not to interfere with theatre clean-up and finishing touches in March 2009. For this reason it is desirable to modify the existing theatre renovation contract to include the construction of this work and to increase the dollar amount by $595,000 for a total contract amount of $8,595,000.
 
Fiscal Impact:  $595,000 is available in Capital Fund 735 Northland and Other Acquisitions under Land Assemblage.
 
Emergency Justification:  Emergency action is requested in order to complete these improvements prior to the theatre opening on April 4, 2009.

Body
 
WHEREAS, the Lincoln Theatre Association is under contract with the City as the developer of the theatre renovations which are underway and scheduled to be completed in March 2009; and
 
WHEREAS, improvements around the theatre perimeter and near public parking areas must be completed in time for the Theatre opening on April 4, 2008; and
 
WHEREAS, construction of these improvements must occur during the 2008 construction season to avoid generating dust during the final clean-up of the theatre; and
 
WHEREAS, it is desirable by both the Lincoln Theatre Association and the City of Columbus to modify the existing contract in scope and dollars in order to complete the improvements in a timely manner; and
 
WHEREAS, an emergency exists in the usual daily operation of the Department of Development in that it is immediately necessary to enter into a contract modification with the Lincoln Theater Association to allow right-of-way improvements to be completed during the 2008 construction season prior to the theatre opening on April 4, 2009, thereby preserving the public health, peace, property, safety, and welfare, and NOW, THEREFORE,
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
 
Section 1.      That the Director of Development be and is hereby authorized and directed to amend contract EL007070 with the Lincoln Theatre Association by increasing the scope and dollars by $595,000 to construct right-of-way improvements around the perimeter of the theatre and near the public parking lot on the north side of Long Street.
 
Section 2.      That for the purpose stated in Section 1, the expenditure of up to $595,000 from the Development Department, Division No. 44-01, Fund No. 735 Northland and Other Acquisitions, Project No. 441747 Land Assemblage, OCA Code 735747, Object Level Three 6680 is hereby authorized.
 
Section 3.      That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
 
Section 4.      That it is further agreed that in all other aspects, this contract remains unchanged.
 
Section 5.      That for reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
