BACKGROUND: This legislation authorizes the Director of the Department of Development to modify and reduce the contract amounts and extend the contract term dates through the period of performance from February 28, 2026 to June 30, 2026 with Black Bronco Constructions LLC, Coliseum Home Improvements LLC, MacRester Zacarias, DBA Kairos Construction Group LLC, and Reliable Home Improvements of Ohio, Inc. and is contingent upon the passage of Ordinance 0384-2026. This is an unplanned modification but is necessary due to the grant extension.

The Department of Development advertised RFQ027423 on Vendor Services and proposals were received through Bonfire seeking contractors to provide lead safe abatement services for residential properties on April 10, 2024 with bids being due on May 7, 2024
Black Bronco Constructions LLC was awarded the contract and authorized by Ordinance 1877-2024, Coliseum Home Improvements LLC was awarded and authorized by Ordinance 1876-2024, MacRester Zacarias, DBA Kairos Construction Group LLC was awarded and authorized by 1875-2024 and Reliable Home Improvements of Ohio, Inc. was awarded and authorized by 1874-2024. The contracts are authorized through the program year 2026 with the option to renew for one (1) additional year.
In accordance with C.C. 329.09(a):
1. No additional funds are required by this ordinance.
2. This grant originated from Ordinance 3209-2023 which expires April 30, 2026. Pursuant to Ordinance 0384-2026 the State of Ohio wishes to allow the City to utilize some of the remaining dollars from this grant and have the termination date extended to August 31, 2026.
3. It is in the City’s best interest to extend the agreement term end dates to continue to provide lead-safe housing in high-risk zip codes by conducting lead-safe renovations on windows, doors, and porches in homes built before 1978.
On December 7, 2023 Columbus City Council approved Ordinance 3209-2023 which authorized the Director of the Department of Development to accept and execute a reimbursable Lead-Safe Housing Renovation, Repair, and Painting (RRP) Grant, in an amount up to $5,356,000.00, from the Ohio Department of Development (ODOD) which expires on April 30, 2026. The State has determined based on the progress of our program that the full grant amount will not be expended therefore they have reduced the overall grant amount and have extended the agreement. The State of Ohio wishes to allow the City to utilize some of the remaining dollars from this grant and have the termination date extended to August 31, 2026 pursuant to Ordinance 0384-2026. The primary goal of this program is to assist low- and moderate-income owners with primary prevention and to reduce immediate and presumed lead hazards in residential properties built before 1978.
The contracts with Black Bronco Constructions LLC, Coliseum Home Improvements LLC, MacRester Zacarias, DBA Kairos Construction Group LLC, and Reliable Home Improvements of Ohio, Inc. provide lead safe renovations such as, but not limited to, roof replacements, framing to soffits, fascia, rakes, rafters, and trusses as necessary; installation of gutters/downspouts, repair of porch structure; and wrapping or painting of soffits, fascia, and rake boards.

Fiscal Impact: There will be a reduction in the grant award which will reduce the authorized expenditure amounts as well as appropriation in the amount up to $3,056,000.00. This legislation is contingent upon the passage of Ordinance 0384-2026
Emergency Designation: Emergency action is needed to assure there is not an interruption of services and the City will continue to provide lead mitigation which will help decrease health issues related to the continued exposure to lead.

To authorize the Director of the Department of Development to modify and reduce four contract amounts with Black Bronco Constructions LLC, Coliseum Home Improvements LLC, MacRester Zacarias, DBA Kairos Construction Group LLC, and Reliable Home Improvements of Ohio, Inc., extend the contract term dates through the period of performance from February 28, 2026 to June 30, 2026; and declare an emergency. WHEREAS, the Director of the Department of Development executed four contracts with Black Bronco Constructions LLC, Coliseum Home Improvements LLC, MacRester Zacarias, DBA Kairos Construction Group LLC, and Reliable Home Improvements of Ohio, Inc. to provide lead safe abatement services; and
WHEREAS, this modification is needed to reduce the contract amounts as well as extend the term dates in order to continue the program’s period of performance through June 30, 2026; and
WHEREAS, an emergency exists in the usual and daily operation of the Department of Development in that it is immediately necessary to allow for the reduction of the contract amounts as well as the extension of the contract term dates so the contractors can continue to provide services under the Lead-Safe Housing RRP grant pursuant to the passage of Ordinance 0384-2026, which will help decrease health issues related to continued exposure to lead and allow the program to operate without interruption through June 30, 2026, all for the immediate preservation of the public health, peace, property, safety and welfare; NOW THEREFORE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of the Department of Development is hereby authorized to modify and reduce the contract amounts and extend the contract term dates through the period of performance from February 28, 2026 to June 30, 2026 with Black Bronco Constructions LLC, Coliseum Home Improvements LLC, MacRester Zacarias, DBA Kairos Construction Group LLC, and Reliable Home Improvements of Ohio, Inc. contingent upon the passage of Ordinance 0384-2026.
SECTION 2. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
