Explanation
 
BACKGROUND:  On April 11, 2005 City Council passed Ordinance number 0587-2005 authorizing the Finance Director to increase contract number CT-09367, with Itron, Incorporated, for continued maintenance of software and hardware of a data capturing system.  It was noted after legislation passed that the original contract was modified by the Division of Water in order to purchase upgraded hardware and software.  The new purchase terminated the old contract.  Contract number PR-29519 was entered into in order to replace contract number CT-09367.  Therefore, the Division of Water is requesting that Ordinance number 0587-2005 be amended to reflect the correct contract number.
 
It is requested that this Ordinance be handled in an emergency manner, as we would like to have the new Purchase Order established so we can pay the invoice as quickly as possible.
 
FISCAL IMPACT:  There is no additional fiscal impact.  We are just correcting an incorrect contract number.

Body
 
WHEREAS, City Council passed Ordinance number 0587-2005, on April 11, 2005, authorizing the Finance Director to increase contract number CT-09367, with Itron, Incorporated, for continued maintenance of software and hardware of a data capturing system, and
 
WHEREAS, original contract number CT-09367 was terminated by the vendor and was replaced by PR-29519, and
 
WHEREAS, the Division of Water is requesting Ordinance number 0587-2005 be amended to reflect the correct contract number, and
 
WHEREAS, an emergency exists in the usual daily operation of the Division of Water, Department of Public Utilities, in that it is immediately necessary to amend Ordinance number 0587-2005, to reflect the correct contract number, in an emergency manner, as we would like to have the new Purchase Order established so we can pay the invoice as quickly as possible, for the immediate preservation of public health, peace, property and safety; now, therefore,
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That Section 1 of Ordinance number 0587-2005, passed April 11, 2005, is hereby amended to read as follows:
 
That the Finance Director be and is hereby authorized to increase contract PR-29519 with Itron, Incorporated in order to cover maintenance on the hardware and software of the data capturing system, as provided in the above mentioned contract, for the Division of Water, Department of Public Utilities.
 
Section 2.  That for reasons stated in the preamble hereto, which is hereby made a part hereof, this Ordinance is declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
