PROPOSED USE:  Office development.
 
DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (4-0) on October 13, 2005.
 
CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The proposed L-C-2, Limited Commercial District is compatible with surrounding uses and consistent with the land use recommendations of The Northwest Plan (1991), which states, "Support multi-family and office uses as the most appropriate redevelopment uses."

WHEREAS, application #Z05-053 is on file with the Building Services Division of the Department of Development requesting rezoning of 0.56± acres from R, Rural District, to L-C-2, Limited Commercial District; and
 
WHEREAS, the Development Commission recommends approval of said zoning change; and
 
WHEREAS, the City Departments recommend approval of said zoning change because the proposed L-C-2, Limited Commercial District is compatible with surrounding uses and consistent with the land use recommendations of The Northwest Plan (1991), which states, "Support multi-family and office uses as the most appropriate redevelopment uses.", now, therefore:    
 
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

2625 BETHEL ROAD (43220), LOCATED ON THE SOUTH SIDE OF BETHE ROAD, BEING 186' EAST OF GRAYSTONE DRIVE AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:
 
SITUATED IN THE STATE OF OHIO, COUNTY OF FRANKLIN, AND CITY OF COLUMBUS.
 
BEING LOT 1 IN C.B. SHOEMAKER SUBDIVISION, AS THE SAME IS NUMBERED AND DELINEATED UPON THE RECORDER PLAT THEREOF, OF RECORD IN PLAT BOOK 23, PAGE 41, RECORDER'S OFFICE, FRANKLIN COUNTY, OHIO, EXCEPTING A .056 ACRE TRACT DEEDED TO THE CITY OF COLUMBUS IN OFFICIAL RECORDS VOLUME 14745, PAGE A19.

INTRODUCTION
 
Mike Crowe desires to change the property located at 2625 Bethel Road from a rural zone to a L-C-2 Zone area.  It is the intent that for the indefinite future, the existing building will be used as a Real Estate Office.   
      
PERMITTED USES:
 
The intended use of this site will be those allowed by L-C-2 zoning district. There shall not be erected any off premise graphics or billboards.
 
DEVELOPMENT STANDARDS:
 
Unless otherwise indicated in this text, the applicable development standards of Chapter 3353 C-2 Commercial District of the Columbus City codes shall apply.
 
A.  Density, Lot, and/or Setback Commitments.
 
1.  A drop off area and ADA compliance ramps will be placed in back of the existing building.  All parking associated with the current structure shall be located behind the existing building, as shown in Exhibit A.  Any parking associated with a new structure shall also behind the structure.  
 
B.  Access, Loading, Parking, and/or Other Traffic Related Conditions.
 
1.  The access at Bethel Rd will be "right in" and "right out" only.  The driveway will be an independent entrance and exit servicing only the property at 2625 Bethel Road.
 
C.  Buffering, Landscaping, Open Spaces, and/or Screening Commitments.
 
1.  All areas not paved will be yard lawn and kept well maintained.
 
2.  Mounding and hedges will be used to shield car headlights.  The plants or mounding shall reach 36" in height as seen in Exhibits D and E.
 
3.  Two evergreen trees in front of the existing building will be removed.  All other trees will be well maintained.  The rear of the lot will be cut and all wild growth removed or trimmed.  All wild bushes at the base of the front building will be removed.  All non-functioning cars will be removed as well as anything not associated with the office and lot is to be removed.
 
4.  No storing, stacking, arranging, or displaying of items or merchandise, or supplies for sale or for use in the business, is permitted on premises or outside on said site.
 
5.  Any landscape plan shall be in accordance with Exhibits B, C, D and E.
 
6.        Dumpster shall be located behind the structure, as shown in Exhibit A.
 
7.      Lot coverage to include buildings, parking and service areas shall not exceed 85% of the designated lot (credit shall be given for setback areas if not paved).
 
8.      All propane tanks shall be fully screened as provided in fire and safety design standards.
 
 
D.  Building Design and/or Interior-Exterior Treatment Commitments.
 
1.  The outside of the building will be painted gray.
 
2.  The outside garage door will be enclosed and siding will be added to give this area a uniformed look to the rest of the building.
 
3.  The existing structure will not be expanded or razed.
 
4.  All wiring shall be underground.  Exception where above-ground wires are presently permitted by legal easements to an electric utility company including primary service lines from the above ground wires; all other wiring within a development shall be underground.
 
E.  Lighting, Outdoor Display Areas and/or Environmental Commitments.
 
1.  Any outside lights used to illuminate the parking lot will be shielded to prevent glare to the surrounding environment.  
 
2.  Any outside lights will be recessed and aimed downward to prevent glare to the street.
 
3.  All lights (fixtures) shall be from the same or similar manufacturer and shall be either brown or black in color.
 
F.  Graphics and/or Signage Commitments.
 
1.  All signage and graphics shall conform to Article 15 of the Columbus Graphics Code.  Any variance to these requirements will be submitted to the Columbus Graphics Commission for consideration.
 
SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
