Title: To authorize the Public Service Director to enter into agreement with the Director of the Ohio Department of Transportation for the State Route 317 reconstruction project for the Transportation Division; and to declare an emergency. ($0.00)
Explanation
 
Background:  This ordinance authorizes The Public Service Director to enter into an agreement with  the Ohio Department of Transportation (ODOT) for a Hamilton Road Project which involves rehabilitation and widening of 0.06 miles of pavement and the structure, Hamilton Road over Truro Station Road and a pair of Norfolk and Southern Railroad Tracks.  Work also includes the removal and reconstruction of the concrete median and overlay of the existing pavement for the distance required for the Maintenance of Traffic, lying within the City of Columbus. ODOT has agreed to work with the City of Columbus to provide pedestrian access across the bridge once this project has been completed.  The bridge is being reconstructed with sufficient width to accommodate pedestrian walkways on both sides.  (FRA- SR317-12.23 PID 18786)
 
Emergency action is requested in order to meet ODOT's schedule to bid this project in May.  In order to do so this paperwork needs to be returned to ODOT as soon as possible.  The project is scheduled to begin construction in June 2007 and end in October 2007.  Bridge Painting is expected to occur in 2008.
 
Fiscal Impact:  The estimated cost of construction for this project is $2,300,000.00.  The total share of the cost for the City is now estimated at $0.00, but the estimated amount will be adjusted so that the City's ultimate share of the cost of the improvement shall correspond with the actual cost when said actual costs are determined.

Body
 
The following ordinance enacted by the City of Columbus, Ohio, hereinafter referred to as the Legislative Authority or Local Public Agency or "LPA", in the matter of the stated described project.
 
WHEREAS, on the 15th day of March, 1999, the LPA enacted legislation (Ordinance 626-99) proposing cooperation with the Director of the Ohio Department of Transportation (Director of Transportation) for the described project:
 
Rehabilitation and widening of 0.06 miles of pavement and the structure identified as FRA-317-1223 on Hamilton Road over Truro Station and a pair of Norfolk and Southern tracks.  Work also includes the removal and reconstruction of  the concrete median and overlay of the existing pavement for the distance required for the Maintenance of Traffic, lying within the City of Columbus; and
 
WHEREAS,  the LPA shall cooperate with the Director of Transportation in the above described project as follows:
 
The City has no financial obligations in the improvement except as shown on construction plans and further, the City agrees to assume and bear one hundred percent (100%) of the cost of  Preliminary Engineering, excluding in-house preliminary engineering charges incurred by the State.
 
In addition, the City also agrees to assume and bear one hundred percent (100%) of the cost of any construction items requested by the City on the entire improvement, which are not necessary for the improvement, as determined by the State and Federal Highway Administration.
 
In view of the fact that the LPA's share of the project is now estimated in the amount of Zero and 00/100 Dollars ($0.00) therefore, the City will not be required to deposit any funds at this time.  The LPA's ultimate share of the cost will be determined when final actual costs and allocations are determined.
 
WHEREAS, the Director of the Ohio Department of  Transportation has approved said legislation proposing cooperation and has caused to be made plans and specifications and an estimate of cost and expense for improving the above described highway and has transmitted copies of the same to this legislative authority; and
 
WHEREAS,  this legislative authority desires the Director of Transportation to proceed with the aforesaid highway improvement; and
 
WHEREAS,  an emergency exists in the usual daily operation of the Department of Public Service, Transportation Division, in that it is the sense of this Council that the Director of the Ohio Department of Transportation must proceed with the aforesaid highway improvement, thereby preserving the public health, peace, property, and safety; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the LPA hereby requests the Director of Transportation to proceed with the aforesaid highway improvement.
 
Section 2.  That the LPA enter into a contract with the State, and that the Public Service Director be, and is hereby authorized to execute said contract for improving the described project.
 
Section 3.  That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten day after passage if the Mayor neither approves nor vetoes the same.
