Explanation

 

BACKGROUNDThis legislation authorizes the Director of Public Safety to enter into an agreement with Air Flite to serve as a broker for the sale of the Bell 407GXi helicopter serial number 54906, the proceeds of which will be used to enhance our helicopter fleet by purchasing mission critical equipment, maintain our flight hours by retaining our complement of 5 helicopters, improve operational abilities, and address public concerns regarding noise. 

 

To obtain the highest possible revenue from the sale, the use of a broker is the best possible solution due to the uniqueness of this equipment.  The City of Columbus has used the services of Air Flite as a broker in the sale of helicopters for a number of years.  The Department of Public Safety is requesting that the provisions of Chapter 329 of the City Code pertaining to the sale of city-owned personal property be waived. 

 

Contract Compliance: Air Flite Inc's CC No. CC041640

 

This company is not debarred according to the Federal excluded parties listing or prohibited from being awarded a contract according to the Auditor of State unresolved findings for recovery certified search.

 

Emergency Designation: This ordinance is being submitted as an emergency measure in order to expedite the sale of the helicopter.

 

FISCAL IMPACT: The revenue generated from this sale will be deposited in the Special Income Tax Fund.

 

Title

 

To authorize and direct the Director of Public Safety to enter into a contract with Air Flite for the sale of a  Bell 407GXi helicopter, to waive the provisions of Chapter 329 of the Columbus City Codes pertaining to the sale of city-owned personal property; and to declare an emergency.

 

Body

WHEREAS, a need exists to sell a Bell 407GXi helicopter serial number 54906 which is no longer in use; and

 

WHEREAS, the use of a broker is the best possible solution due to the uniqueness of this type of sale; and

 

WHEREAS, Air Flite has been used previously as a broker to sell the Division of Police's helicopters; and

 

WHEREAS, it is necessary to waive the provisions of Section 329.34 of the Columbus City Code; and

 

WHEREAS, an emergency exists in the usual and daily operation of the Department of Public Safety,  Division of Police, in that it is immediately necessary to authorize the Director to enter into contract with Air Flite to broker for the sale of a helicopter no longer in use, in order to expedite the sale of the helicopter, for the immediate preservation of the public health, peace, property, safety and welfare, now, therefore

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Public Safety Director be and is hereby authorized and directed to enter into a contract with Air Flite to broker for the sale of a Bell 407GXi helicopter serial number 54906.

 

SECTION 2.  That this Council finds it is in the best interest of the City of Columbus to waive the provisions of Section 329.34 of the Columbus City Codes, 1959, pertaining to the sale of city-owned personal property.

 

SECTION 3.  That for reasons stated in the preamble hereto, which is hereby made a part thereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from the after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
