Explanation
1. BACKGROUND
This legislation authorizes the Director of Public Service to enter into an intergovernmental agreement with and to reimburse the Franklin County Engineer’s Office for work performed during the design phase to the Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr project.
The aforementioned effort, which is being administered by the Franklin County Engineer’s Office, will culminate in the installation of a shared use path along the Dublin Road Corridor from Quarry Trails Metro Park to Limestone Ridge Drive. A portion of the shared use path will lie within the corporate limits of Columbus, and the Department of Public Service has agreed to subsidize a portion of the costs incurred by the Franklin County Engineer’s Office during the completion of the project.
This ordinance seeks to authorize the execution of an intergovernmental agreement between the parties and the encumbrance and expenditure of up to $300,000.00 to advance the design phase of the project. Separate legislation authorizing the execution of additional instruments related to subsequent phases of the project and the encumbrance and expenditure of additional capital funding to support the same will be put forth at a later time.
2. FISCAL IMPACT
Funding in the amount of $300,000.00 is available in the Streets and Highways Bond Fund within the Department of Public Service. An amendment to the 2024 Capital Improvement Budget and a transfer of cash and appropriation between projects within the Streets and Highways Bond Fund are necessary to align budget authority, cash, and appropriation with the proper project.
3. EMERGENCY DESIGNATION
Emergency action is requested in order to meet milestones associated with funding from the Mid-Ohio Regional Planning Commission for the project and to preserve the safety of the traveling public.

To amend the 2024 Capital Improvement Budget; to authorize the Director of Public Service to enter into agreements with and to provide funding to the Franklin County Engineer’s Office relative to the Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr project; to authorize the expenditure of up to $300,000.00 from the Streets and Highways Bond Fund; and to declare an emergency. WHEREAS, the Franklin County Engineer’s Office is administering the Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr project, which will culminate in the installation of a shared use path along the Dublin Road Corridor from Quarry Trails Metro Park to Limestone Ridge Drive; and
WHEREAS, a portion of the shared use path will lie within the corporate limits of Columbus; and
WHEREAS, the Department of Public Service has agreed to assume and bear a proportional share of the project costs; and
WHEREAS, this legislation seeks to authorize the execution of an intergovernmental agreement between the parties and the encumbrance and expenditure of up to $300,000.00, which represents the local share of estimated design costs; and
WHEREAS, it is necessary to amend the 2024 Capital Improvement Budget and to transfer budget authority and funds between projects within the Streets and Highways Bond Fund to support this expenditure; and
WHEREAS, an emergency exists in the usual operation of the Department of Public Service in that is immediately necessary to authorize the Director to enter into an intergovernmental agreement with and to make payment to Franklin County Engineer's Office relative to the Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr project in order to meet milestones associated with funding from the Mid-Ohio Regional Planning Commission for the project and to preserve the safety of the traveling public, all for the immediate preservation of the public health, peace, property, safety and welfare; and NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the 2024 Capital Improvement Budget authorized by Ordinance 1907-2024 be and is hereby amended to provide sufficient budget authority for the expenditure as follows:

SECTION 2. That the Director of Public Service be and hereby is authorized to enter into an intergovernmental agreement with and to make payment to the Franklin County Engineer’s Office relative to the Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr project.
SECTION 3. That the expenditure of $300,000.00 or so much thereof as may be needed, is hereby authorized in Fund 7704 (Streets and Highways Bond Fund), Dept-Div 59-11 (Division of Infrastructure Management), Project P540002-100124 (Bikeway - Dublin Rd - Quarry Trails to Limestone Ridge Dr), in Object Class 06 (Capital Outlay), per the accounting codes in the attachment to this ordinance.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That the funds necessary to carry out the purpose of this ordinance are hereby deemed appropriated, and the City Auditor shall establish such accounting codes as necessary.
SECTION 6. That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project that the project has been completed and the monies are no longer required for said project.
SECTION 7. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the mayor, or ten days after passage if the mayor neither approves nor vetoes the same.
