Explanation
BACKGROUND: In 2006, the Franklin County Municipal Court was funded for a program to offer home incarceration as an alternative to jail when the Franklin County Court of Common Pleas discontinued extending its program to offenders of the Municipal Court. The Ohio Revised Code, under § 1901.26 permits the Court to institute a special project cost in order to offer financial support for the home incarceration program. The Franklin County Municipal Court passed an amendment to Local Court Rule 13, Schedule 9.00 effective March 15, 2007 by way of Court Order Number 01-2007. As a result, the Court has authorized the per diem special project cost of $5.00 per day for program participants which are deposited into fund 226 subfund 003. It is expected, once the program is at full capacity it will generate approximately $82,000 in revenue annually. Program revenues will be used to assist in the support of the home incarceration program efforts within the Court.
This ordinance authorizes the establishment of a new subfund within the Franklin County Municipal Court's special project fund for the purpose of accepting funds specifically generated from the participants who are self paying to be in the home confinement program.
Emergency action is requested to allow the financial transaction to be posted in the city's accounting system as soon as possible. Up to date financial posting promotes accurate accounting and financial management.
FISCAL IMPACT: This ordinance establishes a special project cost for the receipt of funds generated from the participants who are self paying to be in the home confinement program.
Title
To authorize and direct the City Auditor to establish a new subfund within the Franklin County Municipal Court's special project fund for the receipt of monies related to the Court's home incarceration/home confinement program for self paying offenders; and to declare an emergency.
Body
WHEREAS, it is in the best interest of the Franklin County Municipal Court to establish a new subfund within the Municipal Court's special project fund to receive funds related to the Court's home incarceration/home confinement program; and,
WHEREAS, an emergency exists in the usual daily operation of the Franklin County Municipal Court in that it is immediately necessary to authorize the creation of this subfund for receipt of monies related to the Court's home incarceration/home confinement program, thereby preserving the public health, peace, property, safety and welfare; now therefore,
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Auditor be and is hereby authorized and directed to establish a subfund, within the Franklin County Municipal Court, special project fund, fund number 226 to account for revenues that relate to the Municipal Court Judges home confinement/home incarceration program.
SECTION 2. That the City Auditor is authorized to make any accounting changes necessary to ensure that this transaction is properly accounted for and recorded accurately on the city's financial records.
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
