Title: To authorize the Director of the Public Service Department to execute those documents necessary to allow the City to grant an encroachment easement into the south side of the East State Street right-of-way adjacent to 229 East State Street to allow for the construction of footings for a proposed building addition to the Schoedinger Funeral Home at 229 East State Street.
Explanation
 
The Public Service Department, Transportation Division, recently received a request from Greg Martin of Lincoln Construction Inc., on behalf of State Street Limited, asking that the City grant an encroachment easement into the south side of the East State Street right-of-way adjacent to 229 East State Street.  This 0.33' X 22' easement is required for the construction of footings for a proposed addition to the Schoedinger Funeral Home at 229 East State Street.  Per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined that there would be no adverse impact to the City upon the granting of this easement.  A value of $500.00 was established for the granting of this encroachment easement.
 
The City will receive a total of $500.00, to be deposited in Fund 748, Project 537650, as consideration for the granting of the requested encroachment easement.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, recently received a request from Greg Martin of Lincoln Construction Inc., on behalf of State Street Limited, asking that the City grant an encroachment easement into the south side of the East State Street right-of-way adjacent to 229 East State Street; and
 
WHEREAS, this easement is necessary to allow for the construction of footings for a proposed addition to the Schoedinger Funeral Home at 229 East State Street; and
 
WHEREAS, per current Transportation Division practice, comments were solicited from interested parties, including City departments and private utilities before it was determined there would be no adverse impact to the City upon the granting of this easement; and
 
WHEREAS, a value of $500.00 has been established for the granting of the requested encroachment easement; now, therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
 
Section 1.  That the Director of the Public Service Department be and is hereby authorized to execute those documents necessary to allow the City to grant the following described encroachment easement to State Street, Ltd; to-wit:
 
Situated in the State of Ohio, County of Franklin, City of Columbus, and being a 4 inch strip easement within and abutting the southerly right-of-way line to E. State Street, said E. State Street being of record on the plat of "Kelly, Northurp, and Kerr's Allotment of Central Reservation" of record in Deed Book 19, Page 464, and as shown on the plat of "Brotherton and Walcutt's Addition to Columbus", of record in Deed Book 12, Page 199, all record references described herein being to records of the Franklin County Recorder's Office, Columbus, Ohio, and said strip easement being more particularly bounded and described as follows:
Beginning for reference at the intersection of the southerly right-of-way line to E. State Street with the easterly right-of-way line to S. Fourth Street;
Thence N 78°00'00" E, along the southerly right-of-way line to E. State Street, and passing at 378.09 feet, an iron pin at the northwesterly corner of a 0.269 acre parcel conveyed to 209 State Street, Limited, in Instrument Number 200304240120057, a total distance of 418.39 feet to a point at the southwesterly corner, and the true point of beginning of the easement area herein described;
Thence leaving the southerly right-of-way line to E. State Street and the northerly line of said 0.269 acre parcel, N 12°00'00" W, into said E. State Street, a distance of 0.33 feet to a point;
Thence N 78°00'00" E, along a line parallel and 0.33 feet northerly, measured perpendicularly from the southerly right-of-way line to E. State Street, a distance of 22.00 feet to a point;
Thence S 12°00'00" E, a distance of 0.33 feet to an iron pin on the southerly right-of-way line to E. State Street, said iron pin also being at the northeasterly corner of said 0.269 acre parcel;
Thence S 78°00'00" W, along the southerly right-of-way line to E. State Street and the northerly line of said 0.269 acre parcel, a distance of 22.00 feet to the true point of beginning, containing 7.33 square feet, more or less.
The bearings, as defined herein, are based upon the bearing of the southerly right-of-way line to E. State Street, described as N 78°00'00" E, in a 0.269 acre General Warranty Deed conveyed to 209 State Street, Ltd., and being of record in Instrument Number 200304240120057, Franklin County Recorder's Office, Columbus, Ohio.

Section 2.  That the $500.00 to be received by the City as consideration for the granting of the requested encroachment easement shall be deposited in Fund 748, Project 537650.
