Explanation

 

Background:  The following is an ordinance to authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, and to expend the monies for payment of acquisition costs in connection with the Harrisburg Pike Electric Utility Easement Relocation Project.

 

 

FISCAL IMPACT:  The Division is requesting an amendment to the 2007 Capital Improvements Budget for purposes of establishing sufficient budget authority for this expenditure.  In addition, this legislation includes a transfer of funds within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund.  The Department of Public Utilities, Power and Water, has determined funding for this project will be from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund.

 

 

Emergency Justification:  Emergency action is requested to allow acquisition of those easements along US62 (Harrisburg Pike) necessary to relocate the Division's overhead electric lines required by ODOT's widening project to begin as soon as possible to meet ODOT's schedule.

 

Title

 

To authorize the City Attorney to acquire fee simple title and lesser interests, contract for professional services, to amend the 2007 Capital Improvements Budget, to authorize the transfer of funds and the expenditure of $122,500.00 from Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund, for costs in connection with the Harrisburg Pike Electric Utility Easement Relocation Project, and to declare an emergency.  ($122,500.00).

 

Body

 

WHEREAS,                     the City of Columbus is engaged in the Harrisburg Pike Electric Utility Easement Relocation Project; and

 

WHEREAS, it is necessary for this Council to authorize the City Auditor to transfer funds within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund; and

 

WHEREAS, it is necessary to authorize an amendment to the 2006 Capital Improvements Budget for purposes of providing sufficient funding and spending authority for the aforementioned project expenditures; and

 

WHEREAS,                     an emergency exists in the usual daily operation of the Department of Public Utilities, Division of Power and Water (Power), in that it is immediately necessary to authorize the transfer and expenditure of funds within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund, and to authorize the City Attorney to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the aforesaid professional services necessary in connection with said project for the preservation of the public health, peace, property and safety; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

 

SECTION 1.                     That the City Auditor is hereby authorized to transfer the unencumbered balance in a project account to the unallocated balance account within the same fund upon receipt of certification by the Director of the Department administering said project; that the project has been completed and the monies are no longer required for said project except that no transfer shall be so made from a project account funded by monies from more than one source.

 

SECTION 2.                     That the City Auditor is authorized to establish proper project accounting numbers as appropriate.

 

SECTION 3.                     That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this Ordinance.

 

SECTION 4.                      That the City Auditor is hereby authorized and directed to transfer $24,309.48 from within the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund, Fund No. 553, Object Level Three 6601, Department of Public Utilities, Division of Power and Water (Power), Division 60-07, as follows:

SECTION 6.                     That the City Attorney be, and hereby is, authorized to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary in connection with the Harrisburg Pike Electric Utility Easement Relocation Project, #670771.

 

SECTION 7.                      That the City Attorney be, and hereby is, authorized to expend $122,500.00, or so much thereof as may be necessary, in order to acquire fee simple title and lesser interests in and to certain parcels of real estate and to contract for the professional services necessary, from the Voted 1995 and 1999 Street Lighting and Electricity Distribution Improvements Fund, Fund No. 553, Department of Public Utilities, Division of Power and Water (Power), Dept./Division No. 60-07, Object Level Three 6601, Project No. 670771, OCA Code 670771.

 

SECTION 8.                      That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
