Rezoning Application:  Z04-037.

 

APPLICANT:  Creative Housing Inc.; c/o Donald Plank, Atty.; Plank and Brahm; 145 East Rich Street; Columbus, Ohio 43215.

 

PROPOSED USE:  Multi-family residential development.

 

DEVELOPMENT COMMISSION RECOMMENDATION:  Approval (5-0) on June 10, 2004.

 

CITY DEPARTMENTS' RECOMMENDATION:  Approval.  The applicant is requesting the PUD-8, Planned Unit Development District to develop two four-unit dwellings  to provide housing for the developmentally disabled.  Staff is able to support multi-family residential land-use because proposed development standards provide mounded headlight screening and extensive landscaping along the west property line adjacent to existing single-family housing, a 34-foot side yard and landscaping along the south property line, and substantial front yards along South James and Scottwood Roads.  The site design includes interior and perimeter sidewalks, lighting restrictions and a commitment to a specific front building elevation.

To rezone 1558 SOUTH JAMES ROAD (43209), being 1.1± acres located at the southeast corner of South James and Scottwood Roads, From:  SR, Suburban Residential District, To:  PUD-8, Planned Unit Development District (Rezoning # Z04-037).

 

 

Body

 

WHEREAS, application #Z04-037 is on file with the Building Services Division of the Department of Development requesting rezoning of 1.1± acres from SR, Suburban Residential District, to PUD-8, Planned Unit Development District; and

 

WHEREAS, the Development Commission recommends approval of said zoning change; and

 

WHEREAS, the City Departments recommend approval of said zoning change because the applicant's request for the PUD-8, Planned Unit Development District to develop two four-unit dwellings to provide housing for the developmentally disabled.  Staff is able to support the proposed multi-family residential land-use because proposed development standards provide mounded headlight screening and extensive landscaping along the west property line adjacent to existing single-family housing, a 34-foot side yard and landscaping along the south property line, and substantial front yards along South James and Scottwood Roads.  The site design includes interior and perimeter sidewalks, lighting restrictions and commitment to a specific front building elevation; now, therefore:

 

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:

 

SECTION 1.  That the Official Zoning Map of the City of Columbus, as adopted by Ordinance No. 0179 -03, passed February 24, 2003, and as subsequently amended, is hereby revised by changing the zoning of the property as follows:

 

1558 SOUTH JAMES ROAD (43209), being 1.1± acres located at the southeast corner of South James and Scottwood Roads, and being more particularly described as follows:

 

ZONING DESCRIPTION:  1.1 ACRES

 

Beginning at a PK nail set in the centerline of Scottwood Road at the northeast corner of the Berwyn Subdivision as delineated and recorded in Plat Book 33, Page 46 and in the south line of the Kingsgate Addition as delineated and recorded in Plat Book 22, Page 30 also being in the north line of said 2.412 acre tract;

 

Thence North 89º 55' 12" East 184.29 feet, in the centerline of Scottwood Road and in the north line of said 2.412 acre tract, to a PK nail found marking the northeast corner of said 2.412 acre tract and the west line of the Scottwood Subdivision as delineated and recorded in Plat Book 26, Page 40;

 

Thence South 00º 03' 17" West 259.03 feet, in the east line of said 2.412 acre tract, the east line of said 0.572 acre tract and the west line of said Scottwood Subdivision to an iron pin found marking the southeast corner of said 0.572 acre tract and the northeast corner of Lot 54 in the Berwick Subdivision (passing an iron pin found in the south line of Scottwood Road at 30.00 feet);

 

Thence South 89º 26' 27" West 186.10 feet, in the south line of said 0.572 acre tract, the north line of said Lot 54 to an iron pin set in the east line of James Road (80' in width);

 

Thence North 00º 27' 00" East 260.60 feet, across said 0.572 acre tract and said 2.412 acre tract and in the east line of James Road, (passing an iron pin found in the south line of Scottwood Road at 230.60 feet), to the point of beginning, containing 1.105 acres more or less, of which 0.890 acres are out of said 2.412 acre tract and 0.215 acres are out of said 0.572 acre tract.

 

Basis of bearings from Deed Book 2097, Page 660, based on the centerline of James Road being North 00º 27' 00" East.  A survey of the above described premises was done by Robert T. Partridge, Jr. in October 2001.  All iron pipes are capped Partridge Surveying, Professional Surveyor No. #7462.

 

To Rezone From:  SR, Suburban Residential District,

 

To:  PUD-8, Planned Unit Development District.

 

SECTION 2.  That a Height District of Thirty-five (35) feet is hereby established on the PUD-8, Planned Unit Development District on this property.

 

SECTION 3.  That the Director of the Department of Development be, and he is hereby authorized and directed to make the said changes on the said original zoning map in the office of the Building Services Division and shall register a copy of the approved PUD-8, Planned Unit Development District and Application among the records of the Building Services Division as required by Section 3311.09 of the Columbus City Codes; said plans being titled "PROPOSED NEW EIGHT UNIT APARTMENT DEVELOPMENT FOR:  CREATIVE HOUSING, INC"and "FRONT ELEVATION," both signed on June 11, 2004 by Donald Plank, Attorney for the Applicant.

 

SECTION 4.  That this ordinance shall take effect and be in force from and after the earliest period allowed by law.
