Explanation
1. BACKGROUND
This ordinance authorizes the Director of Finance and Management, on behalf of the Department of Technology, to enter into contract and issue purchase orders as needed with Mako Power LLC for the purchase and installation of two hundred and thirty-two (232) Enersys HX505 batteries in the two existing UPS systems at Data Center West over the course of two consecutive Saturdays, and subsequent environmentally sound disposal of the replaced batteries. In the event of a power outage, the Department of Technology will use the new batteries to power the existing UPS systems that serve as continual power supplies at Data Center West. The existing batteries have reached the end of their life cycle, and pose a risk of failure if a power loss occurs.
The Purchasing Office advertised and solicited competitive bids in accordance with the relevant provisions of City Code Chapter 329 relating to competitive bidding (Solicitation RFQ028877) through Vendor Services. The city received seven bids for the UPS battery replacement goods and services on October 25, 2024, and they were tabulated as follows:

The award is to be made to Mako Power LLC, the lowest responsive, responsible, and best bidder for the UPS battery replacement goods and services, with a bid of $66,044.00.
Searches in the System for Award Management (Federal) and the Findings for Recovery list (State) produced no findings against Mako Power LLC.
2. CONTRACT COMPLIANCE INFORMATION
The contract compliance number for Mako Power LLC is CC000327 and expired 06/18/2020. The vendor will recertify prior to a purchase order being issued.
3. FISCAL IMPACT
Funding in the amount of $66,044.00 is budgeted and available in the Department of Technology’s, Information Services Division’s Operating Fund, Fund 5100.
4. EMERGENCY DESIGNATION
The department requests emergency designation for this ordinance so the new batteries can be put into service as quickly as possible in order to prevent disruption of the city’s data network. The existing batteries have reached the end of their life cycle and may pose a risk of failure in the event of power loss.

WHEREAS, the Department of Technology is responsible for uninterrupted operation of the city’s data network in the event of a power failure; and
WHEREAS, it is necessary to purchase and install two hundred and thirty-two (232) Enersys HX505 batteries and properly dispose of existing aged batteries; and
WHEREAS, the Purchasing Office received formal bids on October 25, 2024, under RFQ028877; and
WHEREAS, Mako Power LLC submitted a bid in the amount of $66,044.00 for UPS battery replacement goods and services; and
WHEREAS, funds are available in the Department of Technology’s, Information Services Division’s Operating Fund, Fund 5100 for this expense; and
WHEREAS, it is necessary to authorize the expenditure of up $66,044.00 with Mako Power LLC for the purchase of UPS battery replacement goods and services; and
WHEREAS, an emergency exists in the usual daily operations of the Department of Technology in that it is immediately necessary to authorize the Director of Finance and Management to create purchase orders with Mako Power LLC so the two hundred and thirty-two new Enersys HX505 batteries can be put into service as quickly as possible in order to avoid disruption of the city’s data network in the event of a power failure since existing batteries have reached the end of their life cycle and may pose a risk of failure in the event of power loss, all for the immediate preservation of the public health, peace, property, safety, and welfare; and now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the Director of Finance and Management, on behalf of the Department of Technology, is hereby authorized to establish contracts with and issue purchase orders Mako Power LLC for the purchase and installation of two hundred and thirty-two (232) UPS batteries, and subsequent environmentally sound disposal of aged UPS Batteries at Data Center West.
SECTION 2. That the expenditure of $66,044.00, or so much thereof as may be needed, is hereby authorized per the accounting codes in the attachment to this ordinance. (See attachment: 3069-2024 Accounting Template)
SECTION 3. Funds are hereby deemed appropriated and expenditures authorized to carry out the purposes of this ordinance and the City Auditor shall establish such accounting codes as necessary.
SECTION 4. That the City Auditor is authorized to make any accounting changes to revise the funding source for all contracts or contract modifications associated with this ordinance.
SECTION 5. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor, or ten days after passage if the Mayor neither approves nor vetoes the same.
