Explanation
This legislation authorizes a modification to the design contract with Dynotec, Incorporated, for the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project.  This project adds a right turn lane to all four legs of the intersection.  This contract modification is necessary revise the signal design to account for new specifications.  This modification is an addition to the original scope of services but is a continuation of the existing work being performed and would not be practical to contract with a different consultant.  Dynotec, Incorporated, contract compliance #31-1319961 (expires September 23, 2008) was selected in 1996 in accordance with the provisions of Columbus City Code Chapter 329 for professional service contracts.  We have negotiated new hourly rates for this modification because the current contract is nine (9) years old.  Costs have increased by approximately three percent (3%) per year for the past eight years.  The overhead rate and percentage of profit from the original contract were used because they are still valid.
 
The original contract amount was for $190,510.00.  The cost of this modification is $50,000.00.  The total cost of the contract including this modification is $255,510.00.
 
Fiscal Impact:  The Transportation Division budgeted $50,000 in the 2005 Capital Improvements in the Miscellaneous Intersection Improvement project.  Actual funds will be available in the 1995, 1999 Voted Streets and Highways Fund as a result of the Fall 2005 bond sale.  This ordinance authorizes an expenditure of $50,000.00.
 
Emergency action is requested for immediate modification of the design contract for the earliest possible completion of the design to stay on schedule.
 
 
 
Title
To authorize the Public Service Director modify and increase an existing contract with Dynotec, Incorporated, for the design of the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project for the Transportation Division; to authorize the expenditure of $50,000.00 from the 1995, 1999 Voted Streets and Highways Fund; and to declare an emergency.  ($50,000.00)
 
 
 
Body
WHEREAS, Contract CT-17522 was authorized by Ordinance 1462-1996, passed June 24, 1996, executed July 19, 1996 and approved by the City Attorney on July 22, 1996; and
 
WHEREAS, it is necessary to modify this contract to increase the scope of services for the Group 9 Intersection Improvements project - Hamilton Road at Livingston Avenue project; and
 
WHEREAS, funds for this contract modification are budgeted in the 1995, 1999 Voted Streets and Highways Fund and are available from the summer bond sale; and
 
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that the contract should be modified and increased immediately so that the work may proceed without delay to stay on schedule, thereby preserving the public health, peace, property, safety and welfare; now therefore
 
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS
 
SECTION 1.  That the Public Service Director be and hereby is authorized to modify and increase Contract No. CT-17522 with Dynotec, Incorporated, 1925 East Dublin-Granville Road, Suite 106, Columbus, Ohio 43229 to revise the construction plans for the Group 9 Intersection Improvements - Hamilton Road at Livingston Avenue project for the Transportation Division in accordance with the documents on file in the office of the Public Service Director.
 
SECTION 2.  That for the purpose of paying the cost of the contract modification, the sum of $50,000.00 or so much thereof as may be necessary be and hereby is authorized to be expended from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-09, Transportation Division, Object Level One Code 06, Object Level Three Code 6682, OCA Code 644385 and Project 530086.
 
SECTION 3.  That for the reasons stated in the preamble hereto, which is hereby made part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
