Explanation
The Public Service Department, Transportation Division, is engaged in the Sawmill Road at Billingsley Road Improvement project. The purpose of this project is to provide a continuous lane from westbound I-270 to eastbound Billingsley Road and a right turn lane from westbound Billingsley Road to northbound Sawmill Road. The Division is also engaged in the Sawmill Road at West Case Road right turn lane project. The purpose of this project is to provide a right turn lane from westbound West Case Road to northbound Sawmill Road.
Successful completion of these projects requires that the City acquire fee simple title and lesser interests in and to various properties located in the vicinity of these intersections. Acquisition costs have been estimated by the Transportation Division to be $10,000.00 and $50,000.00, respectively.
This ordinance authorizes the City Attorney's Office, Real Estate Division, to contract for professional services, negotiate with property owners to acquire the needed rights-of-way and expend the funds needed to pay for acquisition expenses associated with these projects.
Fiscal Impact: The Transportation Division budgeted a total of $160,000.00 in the 2005 Capital Improvements Budget under Roadway Improvements for property acquisition for the Sawmill Road at Billingsley and West Case Road projects respectively. Actual funds will be available in the 1995, 1999 Voted Streets and Highways Fund as a result of the Fall 2005 bond sale. This ordinance authorizes an expenditure of $60,000.00.
Emergency action is requested to allow the City Attorney's Office, Real Estate Division, to begin acquisition of the rights-of-way needed for these projects immediately so that construction of the improvements can proceed as currently scheduled.

WHEREAS, the City of Columbus, Public Service Department, Transportation Division, is engaged in the Sawmill Road at Billingsley Road Improvement project and the Sawmill Road at West Case Road right turn lane project; and
WHEREAS, the purpose of the first project is to provide a continuous lane from westbound I-270 to eastbound Billingsley Road and a right turn lane from westbound Billingsley Road to northbound Sawmill Road; and
WHEREAS, the purpose of the second project is to provide a right turn lane from westbound West Case Road to northbound Sawmill Road; and
WHEREAS, successful completion of these projects require that the City acquire fee simple title and lesser interests in and to various properties located in their respective vicinities; and
WHEREAS, acquisition costs have been estimated by the Transportation Division to be approximately $10,000.00 and $50,000.00 respectively; and
WHEREAS, funds are budgeted in the 1995, 1999 Voted Streets and Highways Fund and will be available subsequent to the fall 2005 bond sale to pay for these acquisition-related costs; and
WHEREAS, an emergency exists in the usual daily operation of the Public Service Department, Transportation Division, in that it is immediately necessary to authorize City Attorney's Office, Real Estate Division, to contract for professional services, negotiate with property owners to acquire the needed rights-of-way and authorize the expenditure of the funds for acquisition-related expenses associated with these projects, thereby preserving the public health, peace, property, safety and welfare; now, therefore
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF COLUMBUS:
SECTION 1. That the City Attorney's Office, Real Estate Division be and hereby is authorized to hire professional services relative to the acquisition of fee simple title and lesser interests in and to real estate needed for the Sawmill Road at Billingsley Road Improvement project and the Sawmill Road at West Case Road right turn lane project, respectively; negotiate with the property owners to obtain the necessary rights-of-way and expend those funds necessary to pay expenses related to these activities.
SECTION 2. That the City Attorney's Office, Real Estate Division, be and is hereby authorized to expend $60,000.00 or so much thereof as may be necessary from Fund 704, the 1995, 1999 Voted Streets and Highways Fund, Department No. 59-05, Transportation Division, Object Level One Code 06, Object Level Three Code 6601, OCA Code 644385 and Project 530161 to pay those costs relative to the acquisition of right-of-way required for the Sawmill Road at Billingsley Road Improvement project ($10,000.00) and the Sawmill Road at West Case Road right turn lane project ($50,000.00).
SECTION 3. That for the reasons stated in the preamble hereto, which is hereby made a part hereof, this ordinance is hereby declared to be an emergency measure and shall take effect and be in force from and after its passage and approval by the Mayor or ten days after passage if the Mayor neither approves nor vetoes the same.
